At the Instsnee of the Kansas City Northwestern Railroad company (Missouri Pacific), the case of the Plata of Na-' brsaka, t rel., the Farm era' Grain and Klevator Co. against the Kanaaa City Northwestern Railroad company, baa been removed on petition to the United States circuit court for the dlatrtot of Ne braska, from the supreme court of the state f Nebraska, on the ground that the su preme court has no Jurisdiction In the matter. Suit originally was brought by the rela tors, the Farmers' Grain A Elevator Co., In the Oase oounty district court to compel the railroad company to build a sldetraok to the elevators of the relators and the case was decided In favor of the relator. The case waa taken to the supreme court Of the atate on appeal, and on March IT a mandate waa Issued by the supreme court requiring the railroad company to build the aiding asked for. and It Is on this man date that the railroad company now ap peals to the United Btatea court' on the plea of nonjurladlotlon In the atate courts. FIM Over lldfUirk. The case Is one wherein the Farmers' Grain Elevator Co. bought an elevator owned by J. V. Allen Bona, and located on the right-of-way of the Kansas City Northwestern railroad, at the town of Vir ginia., Gage county. The new purchasers desired to enlarge the elevator and asked pefmiaslon of the railroad company to do so, but this permission waa denied. Subse quently the Farmers' Grain at Elevator Co. built an elevator adjoining the right-of-way of the railroad company, the front of the elevator being within five feet thereof. Application waa made to the railroad com pany to build a sidetrack to the elevators; but this the railroad company refused to do, although It waa rendering accommo dations to a rival elevator company whose buildings were on Its right-of-way. Tho Farmers' Grain A Elevator Co. claims It Is therefore compelled to haul Its grain In wagons from Its elevator to the railroad tracks at great labor and expense. The company prayed tor and was granted 'a peremptory writ of mandamus out of the supreme court of the state requiring and compelling the 'railroad company to con struct ' a sidetrack to Its elevator. - The railroad company filed Its demurrer April i In the supreme court and now brings' the case to the circuit court of the United States on the plea that the atate courts hove no Jurisdiction. t Invest $5.00 or upward wait See page 11. It Is understood an agreement has about been reached between the roads running east and those running south as to the differential which shall govern. When this differential Is disposed of It Is the opinion of local railroad men that the rest will be easy. The Great West, rn Is ready and willing to make an ad justment of the present differences, accord. Ing to reports which come from the head quarters of the company at St. Paul When an agreement Is reached It Is probable the old rates In effect before the war will be restored. . This Interview Is printed In the Chicago Jeter Ocentvj "There Is practically no danger that the grain rate war will spread to other com modities," says President Stlckney of. the Chicago Great Weatern railway. "A gen eral war would coat too much money. The Northwestern, Burlington, Rock Island and other lines are now paying a heavy price for the privilege of carrying grain. They will not proceed to dlaslpate their revenues further by paying for the privilege of carrying other freight." "When will the grain rate war end?" "We do not know when the Northwestern will tire of the war," grimly replied Mr. Stlckney. "There Is no Immediate adjust ment In sight. We are not doing anything but defending ourselves, and are not mak ing any extraordinary efforts for peace." "Will the old basla of grain rates ever be established?" "Kvery war results In rates being estab lished on a lower basla than before. To re-establish the old rates at once v.ould create enmity, raise public clamor snd lose business. Witn them, were arrested Frank Ramey, Paul Arthbutnot and Charles Prlbovsky, bell boys of a Douglas street hotel. It Is eld the man and woman were much the worse with cocoalne when arrested and that the boys were receiving the first lea stun . In the use of the. drug.
