So far aa rebuilding is conoerned every thing la mill "up In the air" and the only certain result of the failing down of the two old building la that a number of aults will be filed In the district court aa Boon aa tha lawyen can draw up tha necessary paper. H. J. Hughee haa retained Hall Mo Culloch and will bring a damage ault against the Western Real Estate trueteea of Boston, owners of tha building 140$ ZKmglas. for the value of his stock and fixtures and other damage sustained by kirn. A. J. Hanscom, It Is stated, will also trlng suit against the same parties for tha Value of the building. No. 140S Douglas, tuid the loss sustained through Ita falling clown. Representatives of the Western Real Es tate Trustees are also preparing to bring ault against A. J. Hansoom. Whether or not H. J. Hughes will be Included in this ault has not yet been determined. Btlll another suit which may grow out of the natter Is one by A. J. Hanscom against JL J. Hughes. Allocations la Petitions. The main allegation In the first set of ults will be that the destruction of the building, No. 1403 Douglas, and the stock and fixtures In It waa caused by the alter ations In progress to the building No. 1406 Douglas. The main allegation In the other set of aults will be that the falling of tha two buildings was caused by the disintegration and undermining of the party wall between them, such disintegration and undermining being caused by water which dripped onto and through H from an Ice box In tha gro cery store In 1403 Douglas. Boveral old-timers who remember when the upper stories were put on the buildings twenty years ago say that plenty of tes timony can be obtained by both sides to the effect that the buildings have been consid ered unsafe for years, and that when the upper stories were placed on them many remarked that the walls were not strong enough to bear the added weight. Building Inspector Wlthnell has not yet officially done any condemning, and states that the two-story brick on the corner, oc cupied by a pawnshop, tobacco and news store, with lodging rooms above. Is not seriously Injured, and will be allowed to stand. WIUlaaT to Bwtld. Frank B. Kennard. owner of the corner building, atatea that he would strenuously contest any condemning of the building by the city, but that he la perfectly wllUng to tear It down and Join tha owners of the lota to the west In putting up a substan tial block, with stora rooms below and of- Cos rooms on the upper floors. The only obstacle In the way of doing this, so far as ba is concerned, Mr. Kennard says, is that M. Bro&key has a lease on the build ing which does not expire until June IB, 1801, and which contain a provision for an ax tension of the leas for twenty months. The Kennard lot Is 106 feet 9 Inches on fourteenth and 22 feat on Douglas. The Ilaascom, Western Real Estala Trustees and Horbaoh lots to the west are each 13 feet on Douglas and run baok US feet to the alley. Mr. Kennard win suggest to the other owners the erection of a three-story building, of substantial construction, hand' some In appearance and strictly modern. m J.
