The matter cf the habaes corpus prxed-
ings for the possession of Mabel Feperholm
was continued before Judge Vlnsonhalef
this morning until next Monday, after ths
Judge had overruled the objections of C. R.
Scott to the Jurisdiction of the court.
Last week when the case was called for
trial Mr. Scott denied the Jurisdiction of the
court for two principal reason, the first
being that the child being sbsent from tbe
court room the Judge could not pass upon
the application, ss the desire cf th ehlld
should have weight In forming the opinion
of th court. The recond reason we that
the court having secured Jurisdiction over
the child, by .he appointment of s guardian,
it did riot have the power to waive that
Jurisdiction by rlaclng the child In th
custody of a person not within th
Jurisdiction of the court.
The case will now be heard upon Its
merits. No trace of Potts, who disappeared
lth the child after the commencement of
the present suit, has been discovered, but
It is the belief of many that he la not far
from the city end will produce the child
when he believes he will "have no trouble
for his present contempt of court.
