The Mabel Begerholm habeas corpu case wa given another turn yesterday . by Investigation ordered by the county judge, who seems to be making an unusual effort to secure possession of th child, who I now desired by three famllle after (pond ing the first ten year of her life with not even her mother Interested in her welfare. Mr, llanna Anderson, who was mad guardian of th child by Judge Vlnaonhaler and from whom Mabel waa taken by order of Judge Eatelle. cam Into court yesterday morning and said that a man named Mercer saw Louis Pott and th child take a car for Courcll Bluff Wedneday evening; that the child waa dressed In a blue dress and red Jacket and accompanied Pott willingly. Th Judge ent a deputy sheriff to the Totta horn yesterday morning to ascertain If the clothing of the child had been taken, and he held an "executive session" with Mr. Pott. The man sent to the Pott home returned and reported that another woman may be In some way mixed in th case; that the afternoon on which Pott disappeared with the child a woman earn to the house and asked If that wa where Mabel Potts lived. She wa met by the child, who Informed her that she waa Mabel Pott, and th woman then took the child frcm the premise. They had gone only a short dlstanc when they were met by Pott and all three left, pott never re turnlns to the house. Mr. Anderson said that when Mercer saw rotta and the girl getting on the car for Council Bluffs Pott wa carryrng a j bundle. FIVE MEN PRESENT ARE ARRESTED Fatally Assaulted with Ba Ball Bat and Cuspidor for Making; Jeatlna; Remark About Accordeon on Bar, Thomas Leablnl I dead a the result of a saloon fight at Ulrlch' saloon, Twenty seventh and Y streets, late Friday night. Five men are now under arrest, charged with having had something to do with th death of Leablnl. Theae men are: Frank Qurner, Otto Bchoulti, Paul Wlsberg, Os car Gray and Robert R. Oliver. In addi tion to the prisoner the police have on broken cuspidor and one base ball bat a evidence. From what Chief Brlgg can learn the fight started over a word said- In jest about an accordeon. When Leablnls en tered the saloon the five men now under arrest were in the place and the accordeon was on the bar. Leablnl made aome dis paraging remark about a man who would play an Instrument of that kind and then there was something doing right away. When the fuss wa over Leablnl wa laid out on the floor unconscious, while the other who participated were uninjured. A Leablnl roomed upstair over the saloon, he was carried to hi bed and nothing more thought of him until Just be fore noon on Saturday. A he wa still In a comatose condition, a physician wa sent for and the announcement wa mad that Leablnl waa nearlng life' end. Be fore this, however, the police had learned of the fight and had arrested Frank Our ners, Otto Bchoulti and Paul Wlsberg, charging them with disturbing the peace. These three men are employed at Cudahy' and upon request of Superintendent Bheehy were released In order that they might go to work, Sheehy standing good for their appearance In the sum of S100 each. About 1 o'clock Saturday afternoon Dr. McCrann telephoned Chief Brlgg that Leablnl would die within th next hour or two and ao the chief and Detective El felder started out to round up the three men who had bees released In the fore noon. Brlgga found hla man In I'lrlch' saloon and promptly placed thera under ar rest. Wlsberg took to the woods, but was captured without much trouble. Later on Oscar Gray'and Robert Oliver were taken Into custody. There Is no scar on th back of Leablnl' head and It is herefore inferred that he was struck by either the base ball bat or a pop bolt la. The prisoner decline to talk to anyone except Chief Brlgg. To him they stated that during th fight I'lrlch, the saloon keeper, struck Leablnls on the back of the head with the bat. This Is denied by I'lrlch. Others who were in th saloon at the time of the fight aay that Clrich did not strik th blow. For th time being the prisoner ar being held at police headquarter suspicious char acter. The remains are at Heafy's undertaking rooms on North Twenty-fourth street and Coroner Bralley has been notified. More thaa likely the coroner will direct that an autopsy be held In order to ascertain the exact cause uf death. Following th post mortem will come the Inquest. De lonney held an autopsy on the body last evening and discovered the cause of death to be a blood clot on the brain. An Inquest will begin at t o'clock Tuesday morning In th city council chamber. That Board of Review. I There I still considerable talk on the treet about the action of the Board of Review in cutting down th valuation a re turned by Tax Commissioner Fltxgerald. It will be remembered that nt the all-night session it wa agreed to Increase the four packers 15 per cent and the telephone com pany 25 per cent. Thl information wa given to tho pnbllo befor the board went Into executive esslon. When th packer heard of the raise a hurried trip was made to the headquarter of the board and the result waa a reconsideration of the action taken. In explaining this matter Mr. Schultz, a member of the board, ald to a Bee reporter yesterday that he for one wa convinced, after hearing both lde of the case that the packer had been assessed too high when the 15 per cent was added and therefore he thought it no more than right to reconsider and leave the valuation as originally returned by Fltxgerald. An other point Mr. Schulti touched upon was the threat of te packer that ir the valua tion wa raised the matter would be taken into the courts and possibly 60 per cent of thlayear levy might be 'tied up for an in definite period. He assorts most positively that the packers threatened to take thl step unless the Increase wa taken off. In order to save the city from defending ltelf In court and depriving the municipality of the ue of the money for an Indefinite period the board decided It wa bet to recede from It position and certify to th FlUgerald re turn. It may be the middle of the week, or possibly later, before the exact valuation will be known. However Mr. Fltigerald ay that hi esti mate of $17,800,000 Is bout right. Th completed figure of the tax commis sioner must be turned Into the council within fifteen day. Section 122 of the city charter provide that the mayor ind coun cil hall meet some time between July 1 and July 15 for the purpose of passing ordi nance levying taxes for municipal pur poses. The levy to he based upon the ss sessment for the year In which the levy Is made. A three separate meetings will have to he held for the proper passage of these ordinance the council would naturally IIV to have the completed re turn In by July 6. Board of Review Mandamused. "Last evening the three member of the Board of Review, J. J. Fltsgerujd. John F Schultx and Z. P. Hedge, were served with paper issued by Judge Slabaugh citing them to apiear before Judge Kstelle on Wednesday, July 1, to show cause why the assessment increasing th packers 15 per cent should not s'and. Canvas Vote Monday Mght. On Monday night the Board of Educa tion will meet and the vote cast at Tues day' bond election will be gone over. City Clerk Shrlgley will be present at the meeting for the purpose of opening the ballot boxes and assisting the board In every way possible. There will be some little difficulty about this canvass, as in a number of instances the election board completed the school bond returns on the city election bord books. This will cause an Interchange of books to be made a the counall will canvass Its bond election at the same time. Owing to the light vote cast It will not take long for both bodies to go through the book. It may be that the figure a turned In to the clerk on the night of election may be altered lightly, but It 1 hardly thought that enough errors will be found to change the result on any of the four proposition sub mitted. In order to prevent, If possible, fire on July 4. the Fire and Police bonrd yester day directed Chief Garrett and Assistant Chief Holland to notify storekeepers In the busines portion of the city to clean up back yards at once. There were eight bids presented, but as each of the bidders used a different method of ex pressing hi Intentions, each bid being ac companied by plan and specifications, the whole matter was referred to the bridge Committee and the county surveyor to tabu late the bid so that they could be com pared. The bond of the Nebraka National bank and the Union National bank a county depositories were approved and the bond of the Stat Bank of Waterloo waa re ceived. Oliver Chamber resigned a Intern at the county hospital and David Isaac np plied for the position. The resignation was accepted and the application leferred to the hospital committee.
