OOMO Today Is the (Into set for the hearing, before Judge Lee Extelle, of the Injunction secured by John C. Troutan, engineer at tho poatodlcc, restraining City Clerk Shrlglcy from recognizing Counclltnen Johnston aud Vansant. Ar has been stilted before the counrltmen In question will put up a fight In an at tempt to hold their Jobs, while tho opposi tion will, of course, try to secure un order of the court declaring the ofllces vacant. City Attorney Lambert will represent the city clerk In this ease Hnd It Is thought thnt he will bo osslstcd by nttorncyH se cured by the two councllmen whose fcents nro In Jeopardy. According to tho city attorney the mayor has the right under the charter to appoint eouncllmcn to fill vacancies. Section IS of the charter provides that tho mayor and council shall have the power to provide for the election of city officers nnd to pre scribe tho manner of conducting the snme, nnd the returns thereof, and the registra tion of voters, und for deciding contested elections Jn any manner not In conflict with existing laws. Also to provide for filling such vacancies ns may occur In the office of councilman or other ofllce of the city. An attorney interested In tho case 'said yesterday that the question to right of title to un office was not a subject of Injunction and could only be brought nbout by quo warranto proceedings. Should tho caso go to n trial nnd testi mony bo admitted some Interesting develop ments mny be expected, ns Johnston Is de sirous of proving why Martin became hun gry and thirsty during the recess of the council at the time the nppolntmentn wcro made and forgot to come back until after the show was over. Members of the Street Fair company are very anxious to havo tho troublo In the council settled. In order that an ordinance nmy bo passed allowing the company to occupy the public sttects for tho erection of booths. If un ordinance Is passed It means that there will be no fair, hut the chances nre now thnt there will be little illtriculty In securing tho desired permis sion 'I'm CiiiiiiulHiiloiicr'ft WnrU. Tax Commissioner J. J. Kltzgorald Is moving along with his work In good shupe. At the present time he has eight deputies employed and nbout 20 per cent of tho per sonal tax of the city has already been as sessed. While the city council has made no provision for an ofllce for the tax com missioner the work of the ofllce Is going on Just the same. Mr. Fitzgerald Is using his own ufllco, on Twenty-fourth street, and will continue to do so until the council makes htiituhte arrangements. There Is no opportunity nt this period to oven guess on tho total valuation as re turned by the local assesrors, but It Is hoped that It will not bo below Jl'.L'So.UOO. Liquor I.Icpiimpk ltend-. City Clerk Shrlgloy has seventy-six liquor license applications ready to be pre sented to the city council when that august body gets together. While these documents nnd bonds are nil In shape not moro than six saloon keepers have paid the license fco Into the city treasury. It Is stated that 'ho liquor dealers nro holding back pay ments In hopes that the council may repeal the ordinance calling for an occupation tax of $200 on each saloon. .Vt-HllKt-llt DrilKKlntft. When liquor license appllcatlonB were first being advertised and petitions secured Mayor Kelly announced through the presB that the law requiring all druggists to se cure permits to sell liquors would be strictly adhered to. The fight in tho coun cil has tended to attract attention from this matter until tho present time, but It Is understood that when the council convenes on May 20 steps will be taken toward com pelling all druggists to secure permits. These licenses aro, disposed of hy the city for $10 and the feo for advertising tho ap plication Is tho (ante. So far only two of the druggists doing business In the city have complied with the law.
