Fremont Henjamln, the attorney who has attacked thu validity of the assessments made by the city In past years for special Improvements In a number of suits now pending In the district and superior courts, has raised a new point which he contends Is sufficient In Itself to Invalidate the as- essments which he Is attacking. , This new point Is raised in n suit Insti tuted yesterday by him against Robert Bleakly, the city of Council Bluffs and the county auditor and treasurer. Heretofore Benjamin has contended In tho suits now pending thnt the assessments for paving, grading and curbing wero levied upon the property In which he Is interested without uuy regard to the benefits which It derived from tho Improvements nnd thnt nil o? tho statutes of the stntc of Iown nnd nil or the ordlnnlices of the city of Council Bluffs which nuthorlzed such assessments to bo made In any way were unconstitutional and void and In conflict with and contrary to the constitution of the United Stntes. Tho point ralsod by Benjamin Ib that the special assessments ngnlnst tho property Involved were never properly made by tho city council and that therefore tho certifi cates of the city clerk that such assess ments had bet" made were without author ity and consequently void. At tho time these assessments were mado the city clerk used printed blanks and when the notices of assessment were published in the official newspaper of the city a clipping therofrom was pasted In a scrapbook but no copy of the resolution was over entered on the records of tho city council proceedings. It Is contended by Benjamin that the scrap book containing the printed clippings of these special assessment resolutions Is not an official record of tho city. That the county auditor of said county, relying on the said certificate ot tho city clerk, placed the said special assessment on tho tux books of the said county and the said special assessments became u cloud on the title thereto. This now point will bo ralFcd in addition to the others In all tho suits brought by him against tho city and now pending. There are nine of such suits nnd the total amount Involved Is considerable. Tho re sult of theso Bults Is ot much Importance to tho city. Another point raised by the Benjamin in the suit filed yesterday is that no proper notice of tho expiration of the right ot redemption was ever served upon tho per son In actual possession and occupation of tho premUes. Tho law requires that notice shall not only be served upon tho person in whose name tho property is assessed, but also upon tho pcrs6n in actual posses sion nnd occupation. It Is understood that tho state committee Is very nearly evenly divided In the leanings ot the members toward, one or the other of the two factions In state politics, and thnt this will have some bearing ou the location of tho state convention. Examination of tho books ot the compnny, not yet complete, shows that Grnyson was short over j,000, which sum ho is said to hnvo taken from tho company in small amounts ot various tlmr3 In tho past four or five years. Tho company oftlclnls first announced that his books wero all right, but thnt he had overdrawn his salary for one month. It appears now thnt Grayson did In fact open n package of money and take his mouth's salary therefrom, but It also appears ho had been In the habit ot helping himself to what money he needed and making llie honks show accordingly. It Is found that lie.' had been out a day and two nights and had been robbed of a diamond and all his money before he was sent home. His Ufa was Insured for ?S,000, nearly all of which Is collectable, and the family has agreed "to make good to the company the shortage so far as It Is pos sible. At some of the Institutions It was found that Inferior stock had been palmed off on tho trustees and boards by purchas ing agents. It had been tho custom to al most give away tho calves as soon ns pos sible, at the cows were wanted for their milk alone, but now tho state Is raising grade calves and Is making a profit on the deal. Stephen Harris of Kansas City, who was arrested in St. Joseph by tho sheriff of this county, appeared In court today and gavo bonds to answer the charge of em bezzling $5,000 placed against htm In con nection with tho Pcrsons-Dcnlson suit, In volving settlement ot n damage suit against ono Mrs. Crumpton. Harris returned vol untarily and gave bonds. Ho declares his ability to establish his Innocence.
