24 THE OMAHA DAILY JVEE: SUNDAY, Al'im, 7, 15)01. CALLAHAN BECOMES BALKY SUndi Mute When Aikid to FUad in Grimisal Court. JUDGE BAKER ENTERS PLEA FOR HIM Court Ovcrrulm Two Motion tu .Nullify Cotuplnlnt ntiil Mrtn llc KliiuInK of Trial (or April James Callahan was arraigned again yes torduy. This tlmo ho was brought beforo JuiIro Hakcr to plead to tho latest com plaint filed nsalnst lilm by the county at torney, tho complaint which charges that l'at Crowe, John l)oo and James Callahan committed tho crlmo of robbery by stealing $25,000 from IMward A. Cudahy by putting him In fear, etc. Callnhan's lawyers demurred to the com plaint on threo grounds: First, becauso the alleged facta stated do not constltuto nn offenso punishable by tho laws of Ne braska; second, because the Information talcs no facts, but merely conclusions; third, because tho Information was not filed by tho duly qualified nnd elected county attorney of Douglas county. Demurrer In ( err uleil. Judga linker promptly overruled tho de murrer and then thu attorneys moved to iiuash tho Information because there ore threu other suits pending ngaln3t Callahan for thn sumo offense and noun of them have been tried or disposed of. Tho court also overruled this motion. Callahan was asked If he was guilty or cot guilty, but ho refused to plead, his at torneys having advised him to stand mute. "Tho law which provides tho right of a prisoner to stand mute," said tho court, "was Intended for Idiots and others who nro physically unable to plead. In such enscs tho court haB tho right to enter tho plea of not guilty for tho prisoner and that Is whnt will bo done In this cuhc." Judgo Maker set April 23 as tho dato for beginning tho trial of Callahan. IVIint it l'"ev () in u liu Owners of the Century lliire to iny.
