Considerable Interest is being taken lr.
the section of the new charter whleh pro
vides for a rearsessment of the taxes de
clared illegal by the courts. Some who ate
oppoed to the reassessment clslm that such
action would not be lawful and so a num
ber of well known attorneys of Omaha hsve
been railed upon for opinions. In each opin
ion rendered the assertion is made that the
legislature has the power to authorize the
mayor and council to reassess the taxes in
question. If this Is done It will prevent the
necessity for the issuing of about 150.0no
lu general indebtedness bonds for the tak
ing up of the district bonds issued to pay
the cost of the improvements already re
cured. On the other hand some seem to think
that the city at large should pay for tho
paving of Twenty-fourth street, a it Is tho
main road to Omaha and is usod by a large
number of people dally. The packers use
this road to haul manufatrured products to
Omaha and a great deal of freight destined
for this place, but billed for Omahs. is
hauled down over this route. Therefore. It
Is asserted that the people at laige should
pay for this pavement Instead of Inflicting
the expense upon tho persons who own
property abutting upon Twenty-fourth
street. It s reported that an effort will be
mado to have this reassessment section of
the charter amended or entirly obliterated
in the senate.

An extensive grading outfit belonging to
Kllpatrirk llros. A. Collins arrived In tbo
city estcrday from the west ard Is nov
on sidetracks near Shcely station. It Is
understood that this outfit "will be put to
work grading along the Union Pacific right
of way from the summit to South Omaha.
The curve in the track near the summit
will be taken out and a straight line laid
and grading for two more, main line tracks
will be done, it Is expected that this work
will occupy a greater portion of the sum
mer, as a large amount of dirt Is to bo
moved.
The arrival of the grading outfit, which
includes u steam shovel or two. indicates
that a settlement of the question of va
cating certain streets in the northern part
of tho city If, near at hand. For over a
year and a half the city has hunrf back
and declined to acquiesce in the request
of the Union Pacific in connection with tho
vacating of certain stub ends of streets
between Commercial street and the railroad
right of way. Should this matter be set
tled satisfactorily a great deal of worli
in railroad construction will be perforinct;
here this year.
