MINNEAPOLIS, lllnn.. Feb. 11. An eager
throng, contalnlDR man women, blocked
the spacious corridor ot the court house
today, striving to tet Into the large court
room to witness the proceedings In the trial
or Frank H. Hamilton on the charge ot hav
ing murdered Leonard H. Day. The state'
first witness for tbo day was William O.
Dennett, a St Louis traveling man, who
was In the billiard room of the West hotel
at the time ot the tragedy. He saw the
party playing billiards, saw (he Hamilton
party come In and heard Day say to Hamil
ton; ' You're, the man I've been looking
for." He heard the talk In which a woman
was mentioned, but did not catch the drift
of the conversation. He saw the scuffle
between the principals and saw George,

named Barbe., On returning he saw Day on
the floor between IbV two tables. Barbe
had bold ot hJa'rlgli; hand and was sup

The wlttiess conflnued- "I rubbed Day's
other hand and then returned to (he bar
for the brandy. Falling to get any, I re
turned to the side of the- dying man and
found Hamilton and Canfleld there. I told
Hamilton to slap Day's hands and take off
his shoes and rub his feed as his extremi
ties were getting coid. Neither lUmtlton
nor Qanfiejd !! anything. I said 'He is
dying.' Hamilton said 'Is he?' and reached
his hand over Day's breast. We continued
to rub his feet and apply hot water. About
ten minutes afterward the doctor came In
and in five minutes Day died.

. VI said. 'Let us offer a prayer.' I knelt
down and Hamilton knelt by my side. The
prayer was a silent one. An officer came
and stood beside Hamilton and Canfleld. I
.did not hear Hamilton say anything to the
officer nor afterward. I had no knife nor
.had Barbe. Neither ot us had hail any
trouble In the room with anyone."
On cross-examination, Dennett said there
were fifteen or twenty persons In the room
at tho time. There was a row going on
in another part of the room. He had known
Tlarbe about six weeks and had met Day
casually.
Ray Evans was the next witness. He Is
In tho grain business. He described the
salcons he had visited with Hamilton and
his party, and then their going to tho West
hotel. On entering the billiard room he
spoke to Day, whom he knew, and then
turned and Introduced Hamilton to Day.
The two shook hands, and then witness
turned away, without hearing the ensuing
conversation. He described his altercation
with Force, who, he understood, had said
something derogatory about him.
"I asked Force what he had against me.
and for a reply he shoved me down Into a
chair, saying. "Sit down; I don't want to
havo anything to do with you.' Gary then
broke In and said It was no time for trouble
with Force. He got me out of the room, and
when J got, back I was warned by a bell
boy not to go4aras..thcro-had.bcn trouble."

On cross-examination Mr. Penny went
Into the question of what Witness Evans
had drunk during the evening, beginning
with those before he went to the hotel.
The witness appealed to the court to know
whether this was relerant, but was told to
answer. So he detailed a succession of
drinks at arious places. In all he had
drank with Hamilton six or seven times
He denied that he was drunk and that
there waa, loud talk or profanity In the bil
liard room. He had a cut on the back of his
head when he went away, but explained
that It was caused by the back of the chair
Into which Force had pushed him. He had
gone without his "hat because he could not
find It.
Frank M. Nye, tor the defense, arose and
stated to the court that the defense had
learned today for the first time with sur
prise that Darbc would not be produced by
the state. The defense considered him as
an Important witness, and It he could not
be produced would ask that his evidence at
the coroner's Inquest be admitted.
County Attorney Boardman explained that
he was not personally responsible, as bo
h.id come Into office since the commission
of the crime. His predecessor had made
every effort to seoufo Barbe'a attendance.

tion, since be was out ot the state. He ob
Jected to the admission ot evidence at the
inquest because. Barbe had not then been
cross-examined.' The court said the ques
tion would bo argued at the opening of the
next session, The last witness, of the morn
Ing waa.Charles L. Ferris, attendant In the
billiard room. He heard Day say to Ham
ilton: You are the man I have been look
lng for," and the rest ot the conversation
that ensued, as told by witnesses. After
the first scuffle he put away all the cues and
balls, covered the tables up and took the
beer glasses back to the bar. When he re
turned he met Hamilton and Canfleld com
lng out and the affair was over. After
wards bo saw Hamilton sitting with a police
officer In the bar room, Ferris named all
the persona nresent In the room, George
Fore. Gray, Evans. Canfleld, Hamilton
Bennett. Barge, Ruel and a traveling man
he did not know, who went out before
Hamilton came In. Ruel went out before
Day died. He swore positively that there
were no others In the room. On cross-examination
he said George reached down
and helped Hamilton and Day up after the
first scuffle, but witness did not think he
parted them.
The noon recess was then taken.

On the opening of the court In the after
noon the defense moved that the county
attorney be required to produce A. M. Barbe
In court us a witness. Mr. Penney pointed
out that the laws provided for furnishing
the expense money required In advance by
the witness. The court denied the mo
tion and an exception waa noted.
Stephen O'Malley, watchman at the West
hotel, gave Important evidence. He put
young Evans out because he was drunk,
noisy and quarrelsome. He saw Hamilton
on top ot Day, but saw no blows struck.
Indeed, It Is remarkable that not a single
witness thus far saw a blow struck by Ham
ilton. O'Malley arrested Hamilton on the
advice of Canfleld, who was one of the prlJ
oner's companions, but who said to him:
"Hold that man."
Hamilton said not a word tin to the
time O'Malley turned him over to Police
man Rooney, to whom the state charges
that he made a confession. O'Malley Iden
tified a big wooden-handled knife, with one
broad, rusty blade, an the one he picked up
near Day's body.
On crosa-exarulnatlon the watchman men
tioned for the first time in the case "a mys
terious stranger." When he caifle back
after putting Evans out he saw a "slim,
tall man, with Iron gray mustache, weigh
ing about 150 pounds," standing near a
billiard table. This bit of evidence greatly
pleased the defense. 1

described the cuts on the body. Identified
the knife and declared, after the defense's
objection had been overruled, that. tho blade
of the knife could have caused the cuts.

gave some unexpected evidence. He had
been attracted to the billiard room by hear
ing that some one had been hurt there
and had gone In twice. Each time Day was
lying on the floor. The first time there
was no knife by his body, but the second
time thero was. He swore postlvely that
there was no one near Day's body the first
time be went In. This contradicts the tes
timony of several others of the state's wit
nesses. There were other Important dis
crepancy between his story and those told
by the others.
The sensation of the day was the calllnz
of Caroline Slagle as a witness. She said
she had known both Day and Hamilton
for about three months. She admitted hav
ing vIsltH Hamilton In jail and said she
was still on friendly terms with him.
Asked It she had had a certain conversation
with Hamilton before tho tragedy, she
turned to the judge and said:
"I understand that It Is privileged.-'
The defense Insisted that the witness be
Irstructed that she need not testify to any
thing that might tend to Incriminate her
self. At least the state should put Its
questions In writing and submit them to
the court before they were put to thp wit
ness. After a consultation between the
court and the lawyers, the court ruled that
If the evidence tended to Incriminate the
witness she need not answer.
"That Is all," said the county attorney.
Mr. Penney asked If she was intimately
connected with either Day or Hamilton.
She said she was not and was then excused.
After recalling Force and George to clear
up some minor points, court adjourned for
the day.

TAKES LAUDANUM AND DIES

Alexander M. McCargar. formerly clerk
for the Dunning Hardware company and
later for tho James Morton & Sons com
pany, committed suicide In a boarding
house, 615 South Thirteenth street, Monday
by taking a large dose ot laudanum. He
left no word explaining why he took his
own life, but It l learned that he re
turned to his home at 1S09 Webster street
Thursday night In a drunken condition
and quarreled with his wife. He left, vow.
lng that he would never come back. The
wife did not see blm again until the un
dertaker brought his body home. They
have, a 13-year-old daughter.
Theodore Grabbengeeser. keeper of ths
boarding house, tells this story: "The man
came to my house at S o'clock this morn
ing and asked for a room. I showed him
up; he paid me 23 cents and said that he
didn't want to bo disturbed until tomor
row". That aroused my suspicions, but as
he cecmed to to all right and perfectly
sober I couldn't refuse to let blm have tho
room.
"After remaining In tho room about two
hours be came down stairs and tried to
send one at my children across the street
to the drug store for a bottle ot laudanum,
but the child refused to go and a tew min
utes later he went himself. I didn't learn
about this until about 7:30 this evening.
As soon as I heard ot It I went up to his
room, taking a young man, named Kar
stens, with me. We found the door locked.
Aa there was no answer to our knock we
broke the lock, entered and found the man
lying on the bed, apparently dead."

and began to use, a stomach pump, but
without avail.
On the washstand In the room were two
three-ounce bottles, one full of laudanum,
the other with about a teaspoonful ot the
drug In the bottom. There was also a
glass with a few drops ot the poison In
It, from which he bad drunk the potion.
A screwdriver, a Jack knife, a few lead
pencil stubs, 2 cents in money, a trunk and
valise key and several letters made up
his effects.
The body was turned over to t!ie coroner
and an Inquest will probably be held to
day.

gram.) The Investigation committee met
today and organlted by the selection of Rep
resentative Benedict chairman. William
Watlace of Aberdeen was selected as ete
nographer at I7.S0 a day, E. L. Thomas of
Huron clerk at 14 a day. and A. C, Ooffe of
Sully county marshal at M a day. The
committee formulated rules In executive
session. A resolution was Introduced giv
ing the commission fuller powers. The In
vestigating committee wilt begin work
Thursday and have summoned ex-Governor
Lee, Private Secretary Tom Ayres and Pub
lic Examiner Morris Taylor to appear on
that date.
Governor Herrled appointed a brand com
mission of Noah Newbanks of Stanley
county, a democrat, reappointed; Henry 0.
Anderson of Meade and J. M. Parmlee of
Edmunds county, who Is secretary of the
South Dakota Livestock association.
In the house a petition from Drown
county was presented asking for distribu
tion ot railroad school taxes throughout
the county Instead ot In the townships alone
where the roads cross. The committee on
agriculture reported favorably on the sen
ate bill to encourage the formation ot
farmers' institutes, and a favorable report
was returned on the senate cannon cracker
bill.
The first proposition after the preliminary
work was a combination which resulted In
the killing ot the wolf bounty repeal and
an adjournment over from Thursday next
to Tuesday of next week. It was started
by a motion by McDougall to call the sen
ate wotf bounty repeal from the committee
and Indefinitely postpone It. Llndgren de
manded a division on the question and
when the first portion Carried the fight was
made against the postponement and after
a heated discussion the motion was carried
on roll call by 33 to 29 and the full motion
was carried by the same vote. An effort
to kill the house duplicate of the senate
bill was lost by failure of its advocates to
demand a roll call. The motion to adjourn
was then csiled up and the wolf bounty
backers who have fought It In the past
made a few objections and then most of
them suportcd tt. carrying the motion by
41 to 21.
On the third reading the house bill to
allow a reassessment for local Improve
ments when the first assessment had been
set aside for any reason, was lost. The
senate Joint resolution granting powers to
tho Investigation committee to employ as
sistance and to summon witnesses and com
pel tbem to testify was given three readings
and passed.

The house passed the senate bills to al
low the Issue of tundlug bonds by towns,
allowing personal service tor taking of
depositions of non-residents, making Judg
ment complete and effective a soon as
rendered by the court, attested by the
clerk and filed In his office, and fixing terms
of court In the Eighth judicial circuit.
The principal house bills introduced are.
Creating a state board of charities and
corrections of five of both parties, two to
be women; making the driving ot stock
from their accustomed range a. misde
meanor; liquor license law cutting down
licenses; reducing Interest on tax receipts
from 15 to 12 per rent: making continued
use a legal highway without regard to
time.
In the senate Stewart Introduced a reso.
lutlon memorializing congress to increase
the annual allowance tor Indian pupils
from $1S7 per year to tlSO: requiring hu
mane treatment ot animals to be taugbt
In schools: appropriating 12,500 tor boys
dormitory at Spearflsh, and empowering
cities to maintain lighting plants.
The senate passed tho house bills legal
izing abbreviations In tax lists and ceding
o the general government jurisdiction over
crimes on Inalan reservations.
On account ot numerous absentees no
Important measures were taken up. The
matter of an exhibit at the Buffalo exposl
tlon was settled by the adoption of an ad
verse report by vote of 23 to H.
The senate concurred In the house res
olutlon ot adjournment for four days.
Aa attempt to kill the cigarette license
bill by an adverse committee report was
voted down and the bill goes on the calen
dar. Governor Herrled sent to the senate
the name of II. N. Cooper ot Lincoln county
to be public examiner.

John A. Freeman was sentenced in dis
trict court at Esthervllle to life Imprison
ment for murder. Freeman confessed to
killing his wife In December and burning
his house with her body In it to conceal the
crime. It Is probable ho could never have
been convicted, but he broke down and con
fessed as soon as suspicion was directed
toward him. He could give no reason for
the deed. He had been a Sunday school
teacher In Moline, 111., where he also ed
ited a Norwegian newspaper for a time.

A shooting affray took place In Victor
township, which nearly resulted in the
death of Olaus Anderson. A party of youn
men had gathered for a game of cards when
another comrade, who had been rabbit
hunting, walked In and laid his rifle down
and throwing some cartridges on a stand
said that no one should handle the
weapon. No sooner had he left than oile
of the party picked up the rifle, put in a
cartridge, leveled the rifle at Anderson In
Jest and bade him to hold up his hands
In the excitement his finger struck the
trigger and the weapon was discharged.
The ball lodged under Anderson's eye,
took a downward course through the roof
ot his mouth and lodged In the right cheek.
The blast of powder ruined tho eye and
had the load been anything but a alight
one the young man would have been
killed.

fter a session ot but five days the
United States court has adjourned. Tin
grand jury examined into seventeen cases
and found fourteen true bills. Alac Good
Boy was acquitted of the charge of lar
ceny. John bellow Wolf withdrew his
first plea of not guilty and pleaded guilty
and was sentenced to six months In the
Lawrence county Jail. John Crown Dos
and Owen Keeps the Mountains, Indians
from Rosebud agency, were sentenced for
larceny to one year In the Lawrence county
jail.
One deputy United States marshal found
that most ot his Indian witnesses from the
Slsseton reservation were drunk when it
came time to leave for the east. Notwith
standing the most rigid watching on tho
part ot the marshal the Indians had ob
tained whisky and when the train left they
were stupid. They were loaded onto the
passenger train and sent home the best
way possible.
C. T, Kenned, United States marshal to
South Dakota, left Sunday morning for
California for a visit ot several weeks.

WASHINGTON. Feb. 11. Orders were
buttermakera and make an effort to secure
the convention for Iowa next year. The
convention was held In Lincoln last year
and Des Moines was a candidate. Promises
were made then which, the Des Moines men
believe, will make It easy for Des Moines
to secure the convention for the next meeting,

Dick and George Armstrong, who have
been confined in the county Jail since last
July, and C. M. Hall, made their escape last
night. There were eight other prisoners
In Jail who remained, but all refuse to make
any statement.
The Armstrong boys were In on a charge
ot robbery. The case against Dick was
tried last week, occupying the attention
of the court three days. The Jury was out
from Thursday night until Saturday after
noon, but could arrive at no verdict and was
discharged. George Armstrong would have
been tried this week. The boys were
charged with having allured a simple
minded fellow from tho Fourth of July
celebration at Grlswold out Into the coun
try and there robbed him ot his watch
and some money. Hall was brought up
from Massena on a liquor-selling charge.
The prisoners sawed through a couple of
Iron bars and got into the cuter part of
tho Jail, where bricks In the wall were
removed and the escape made through a
hole 7x10 Inches. The discovery was not
made until 7 o clock this morning. The
prisoners evidently made their escape about
7;30 last night, as they were seen tiy n. u.
McOehon while he was on his way to
church. Fred Beemf. who Is serving a
term In tho penitentiary, was In the Jail,
having been brought here a. a witness, but
did not elcape, as he could easily have done.

der. KNOXVILLE. la., Feb. 11. (Special Tele
gram.) The trial of Alfred Ahn, charged
with the murder of Dr. Hamilton, a promi
nent physician of MaryBvllle, is on at
Knoxvllle this week. The murder was
committed November 26. Just after finish
ing breakfast Dr. Hamilton started for the
barn. He had not gone far when a sharp
report was heard and a rifle ball buried
Itself In the doctor's brain. He uttered
a cry and placing his bands to his head
staggered to his door, where he fell dead.
Ahn was arrested, and since then, It is
said, that a train ot circumstantial evi

The first battalions ot the Twenty-sixth
and Twenty-seventh infantry have been al
ready organized at San Francisco and will
be sent to Manila on the Sheridan, which
sails on the 6th Inst. As the other regi
ments are organized, equipped and drilled
they will be forwarded by battalions to
San FrancUco tor transportation to the
Philippines.
The designation of the new regiments Is
in continuation of the numerical system ot
the existing army. The field and regimental
officers for each of the new regiments have
been chosen and will be officially announced
In a few days. There may be a slight
delay In the assignment of the commanding
officers In view ot the failure of the senate
to act upon the nominations sent In early
last week.

verdict of the Jury, which wait returned
yesterday afternoon, was against the de
fendants Donahue, Baldwin and Leverton
only, and they will probably share In the
