NEW YORK. Jan. II. A. E. Fryo of
Highland, Cal.. who returned yesterday
from Havana, whero ho spent two years as
superintendent of public schools in Cuba,
said Inst night:
"There has been n great Improvement In
the public schools In Cubn. While there
wero not more than 10,000 puplla In 1897
there wero 142,000 In May, 1900. Tho highest
number over registered before the war was
34,000 and tho attendance never exceeded
17,000. There wero no public schools In
reality under Spanish rule, and tho school
property had little or no value. Recently
General Wood got tho Idea that many of
tho schools reported by mo und for which
money was being drawn did not exist. Ho
gathered this by Information furnished by

number of aulas (school rooms), whllo the
military officers counted only tho cscuclas
(school houses), thus confounding matters,

City Attorney Council argued that thern
was no desire on the part of the mayor
and council to defy the court, but on honest
Intent lo carry out tho order In spirit. Ho
stated that since tho court had ordered
the payment of the $159,000 to tho Hoard of
Kducatlou the law had been amended so im
to give the board tho absolute ower to fix
the iimount of laves In mills to be levied
for Its use, nnd that under the present
stntutn the council must lncludo In Its tax
levy whatever number of mills tho school
board demands.

goes lo the Hoard of Education with attend
ing responsibility, and It was the duty of
the school director to mnkn tho burden of
the taxpayers as light as possible. Perhaps
tho board Is not at present lu need ot tho
whole of tho $159,000 and could gel along
with 25, 60 or 75 per cent of the amount,
nud if so It should ask for a levy of only a
sufficient number of mills to cover Its Im
mediate needs, It the board needed thu
entire amount, It could secure It without
enforcing the existing order of tho court,
but by merely adding to Hie levy to bo
made for Its current expenditures a suf
ficient number of mills to cover tho $159,000,
nnd tho mayor and council would ho re
quired by tho stntittcs to grant such a de
mand.
Mr. Herring replied Hint It was not for
Mr. Council nor for the court to dctermlno
ho amount of money needed by tho Hoard
of Education. That was a matter to ho
attended to by tho board Itself and It did
not properly belong lo tho case under argu
ment. All that tho bonrd was now de
manding wns to hnvc a valid decrco of tho
court carried out. The validity of tho de
cree hud not been questioned.

Judgo Fawcett disposed of thu henring by
saying:
"I do not sco any reason why this mailer
can't he cleared up without nny further
quibbling between tho mayor and council
and tho Hoard of Education. Some months
ago the Hoard of Education represented to
this court that It had n deficiency that
must bo met by taxation and on proper
showing I issued an order requiring tho
council to ralso an amount suniclenl to
cover the deficiency nud pay it over to tho
board. Thin order bun not yet been com
plied with nnd Is still In force.
"Now, tho Hoard of Education may under
the law certify to tho city council thnt It
requires a levy of so many mills to meet !tn
expenditures nnd obligations nnd tho coun
cil must levy the tax so domnnded. I don't
see any reason why the board cannot In
clude In its ostlmate for this year n hii in
dent, number of mills to cover this mini ot
$159,000 or nny part of 11 that may ha
needed. If the board desires tho public (o
know thnt this additional levy Is made for
It at this time to cover a deficiency created
under n former bonrd and not for nuy in
crease, in current expenses it may ho state
it In the Items of tho tax levy. If tho
board proceeds In thin way it can get its
money in the near future. If It does not
attain tho desired end by this method, then
I will enforco tho order of tho court di
recting tho council to provldo tho lump
sum of $159,000 for tho board."

court yesterday. Judge Fawcott says he doei
not bellevo In this kind of government ,by
Injunction, and If Credon draws nny money
thut his erstwhile partner hits any right to
