In tho district court yesterday afternoon as
soon as Judgo Green completed reading tho
verdict which pronounced Sentcr not guilty
of uttering tho forged deed whereby Lougee
& Lougcc of this city wero swindled out or
$040 In October, 1S98. Several of the wit
nesses for tho defenso could not restrain
themselves when tho verdict of acquittal
vns announced and gavo expressions to
their feelings by cheering, which was
promptly suppressed by the court olUcers.
Tho trial, which occupied the entire
wcok, was brought to a closo yesterday
morning and tho caso given to tho Jury
shortly heforo tho noon hour. After receiv
ing tho chnrgo from tho Judgo tho Jury won
taken to dinner nnd In about an hour after
Hb return tho verdict was rendered.
On tho convening of. court yesterday
morning Attornoy John Mudd of Memphis'
m ml o tho concluding argument for tho de
fense, during which ho took occasion to
mako some disparaging remarks concerning
E. It. llnrtlctt, who had assisted tho stato
In tho prosecution of tho caso and who had
on tho previous day been placed on the
stand In rebuttal of ovldonco offered by
Eotno of tho defenso's witnesses. Judo
Green wns In his chnmber preparing his
chargo to tho Jury and his absence from tho
court room pormlttcd of a passago of arms
between the two nttornoys from tho Mis
souri town which formed ono of tho sev
eral moro or less sensational features of n
most Interesting and unusual caso. Ilartlctt
resented tho statements mado concerning
him by Attorney Mudd nnd springing to his
feet nnd shaking his clenched fist at Mudd
exclaimed:
"Well, what nbout John Mudd's reputa
tion at his home? You would not daro to
mako theso statements about mo In Mem
phis, and that you know."
Turning on his heel Attorney Mudd
looked nt Ilartlett and said:
"I don't know yet whether you will evet
get back to Memphis."

moro when the court bailiffs Interfered ana
rapped for order and tho Incident closed.
Tho closing argument for tho state was
mado by County Attornoy Klllpack.
Deputy Sheriff Davis of Blue Eartlf,
Minn., was waiting to arrest Senter on a
chargo of swindling John VanSlyke of that
placo last July out of 1,000 on a deal sim
ilar to that In which Lougee & Louge
wore buncoed, but he was disappointed,
Senter's attorneys had boon In communica
tion with Oovcrnor Shaw with a view to
Inducing him to withdraw the granting ot
tho requisition from the governor of Min
nesota and succeeded In so far that Gov
ernor Shaw has granted them a hearing In
tho matter.
Tho following telegram was received by
Sheriff Cousins from W. II. Fleming, pri
vato secretary to tho governor:
"Hold Senter nnd do not surrender him
on requisition warrant until you hear
further from tho governor."
Sonter accordingly was placed In charge
of tho sheriff and will bo hold horo untl?
tho question ot granting tho requisition
from Minnesota Is determined. Tho hear
ing, It Is expected, will bo had before Gov
ernor Shaw Monday at Des Moines.

As a sequel to his acquittal Thomas It.
Senter commenced suit In tho district court
hero last evening against F. C. and E. II.
Lougeo of this city and E. R. Bartlott of
Memphis, Mo., who figured so prominently
in tho prosecution, for damages In the sum
of $50,000, alleging malicious prosecution,
falso Imprisonment and conspiracy against
him. Tho original notice ot tho suit was
served last evening by a deputy sheriff on
tho Lougena and Ilartlctt.
In addition to tho warrant for Senior's
nrrest hold by tho deputy sheriff from Blue
Earth City, Minn., Sheriff Cousins has a war
rant for Sonter on tho chargo of swindling
A. J. Jackson of Morrison, 111., ten years ago
out of a largo Bum of money on a deal simi
lar to tho ono perpetrated on Lougeo & Lou
goo. Tho scvlco of this warrant Is nlso
held up pending tho further hearing before
Governor Shaw.

Tho motion for a new trial In tho personal
Injury damage suit of J. C. Nielsen against
tho City of Council Bluffs, In which Nielsen
secured a verdict against tho municipality
for $1,000, was overruled. City Solicitor
Wadsworth stated that tho caso would ho
taken on appeal to tho supremo court.
Mrs. Clrnco Holbrook filed a suit for dl
vorco from Charles F. Holbrook, to whom
she was married March 7, 189G. Sho al
leges cruel and Inhuman conduct nnd asks
for the custody of tho minor children, aged
