ot removal under wny, and the decision of
the court in the case referred to prevented
him from acting as rapidly as he wished '

The suit Is one brought by John It Woods
to recover damages from Flgg on account
ot alleged malicious prosecution, In having
had him arrested for being among those
who took part in the tar and feather es
capades. For religious reasons Flgg re
fused to como Into court to make a defense.
Judge Slabaugh thereupon entered a Judg
ment against him in the num of $1,200.
On Tuesday there was a hearing on a
motion by FIgg's attorney to set aside the
Judgement and give leave to (lie an answer.
The court held that Flgg had been negligent
and he should have attended to the suit, an
ho ovorruled the motion. In consequence
tho sheriff proceeded to levy against Flgg's
property to 'satisfy tho Judgment Flgg
nnd his followers say they ore anxtous to
get away from Gretna and live In a com
munity where they will not bo annoyed by
non-believers In their creeds. They plan
to build a now place of worship and. add to ,
the community only by conversion.

session of court Judgo Dickinson branded ai'
false the World-Herald's report of bis rul
ing Tuesday with regard to The Bee. He
had been quoted as declaring a tax title
void because tho ovonlng edition of Tho
Bee, In which tho advertisement appeared,

. "Tho article has no foundation In truth,"
saia judge Dickinson. "The only sentence
not absolutely false Is the concession that
In 1896 tho county commissioners ordered
the delinquent tax lists published1 in 'The
Omaha Bee' Now that paper Is known le
gally by two titles. 'The Omaha Dally Dee,'
the morning edition, and "The Omaha Even
ing Bee,' published In the afternoon. The
term used by tho commissioners did net
coincide with tho legal title of either of
these publications and the court so held.
There was not the slightest Intention ot
declaring either paper an Illegal avenue for
publication. The error simply lay with the
commissioners In not properly phrasing the
terms of their preference.
