Wright appears as plaintiff In the last Injunction proceedings and on hh petition Judge Aylesworth of tho superior court Issued a temporary restraining order enjoining tho Suburban company from "placing any street railway tracks or other obstructions over, along and upon Sixth street In front of lot 12, block IS, Illddlu's subdivision to tho city of Council Muffs, la., or from In any manner Interfering with the plaintiff's peaceable possession of sal 1 premises or from removing any dirt fram or tearing up Sixth street In front of an I adjacent to the aforesaid lot or from In any manner obstructing tho entrance to wild property." The odlcers of tho Suburban company aro naturally very indignant over the munner In which thoy aro being obstructed and harassed by tho old company, tho more es pecially as they had made all arrangements to open tho resort nt I.ako Manawa to the public tomorrow. Even with tho injunctions In force thuy had hoped to do this, but the last straw to break tho camel's back camo last evening when Manager Smith of tho Omaha Street Railway company notified Manager Reed of the Suburban line that bis company could not furnUh them power for anything but construction work. It was relying on nn agreement with the Omaha company to furnish power that the Sub urban company had arranged to open Its line from Sixteenth avenue to tho lake to morrow. Without this power, It Is now helpless until It can secure power from Its own plant In East Omaha, which will not be possible for ton or fifteen days. That Lnko Manawa will not bo open to the public on July 4 Is a great disappoint ment to thousands of people In this city who had planned on spending the national holiday there. On every hand sharp und ndverso criticisms of the old company woro to bo hea.rd and the Injunctions ngalnat tho new company were tho principal topics of conversation nnd discussion throughout the city yesterday. Businessmen generally con demn the action of tho old company and It was suggested that a public Indignation meeting bo held. Mayor Jennings and the city officials have been appealed to nnd asked to appoint a committee to wait on tho old motor company and see If the light cannot bo dcclnred off nnd the now com pany permitted to proceed with tho com pletion of Its line without further molesta tion. Ho said: "It Is really too bad that we are not allowed to keep our promise to the public and open Lake Manawa tomor row. We aro helpless, but I can assure the peoplo of Council Bluffs nnd Omaha that wo Intend to stand right by It and will com plete our line sooner or Inter. The old company waited until tho last mlnuto to en Join us, waited until wo had put In our cross ings, hired a band of thirty pieces at a large expense and gono to tho expense of $1,000 In billing tho opening nnd then not satisfied with that stop us getting power from the Omaha Street rallwny. The whole thing Is an outrage, not only an outrnge on us, but on the community at large. Lake Manawa Is the only resort In this vicinity nnd now, thanks to the tactics pursued by the old motor company, the people of this city and Omaha aro dented an opportunity to enjoy It. Wo will get back sooner or later at the old company and get hack nt It hard. It dors not seem right that tho old company should be allowed to enjoin us on putting ip a paltry bond of $.100 while tho damage tuey aro doing us amounts to at least $500 a day." The order Is asked on the grounds th.it tho amendatory act to tho collateral inheritance I tax law cannot apply to real estate which became vsted In the heirs prior to its passage. The-original collateral Inherltnmo tax law was held by the supreme court to bo unconstitutional, but subsequently with the amendatory net was held to be consti tutional. Law son died after the passage of the original act. hut before tho amendatory act was passed. Bechtel of Davenport to exchango $60,000 of outstand ing bonds of tho district, bearing ii and 5 per cent Interest, for n like amount of 4 per cent funding bonds, to bo dated July 2, lyoo. The bonds of tho school district to bo ex changed aro: Ten thousand dollars per cent funding bonds, dated October 1", lRPt; $10,000 14 per cent funding bonds, dated Juno 1, 1S05; $r,000 4',4 per cent school build ing bonds, dated May 1,1830; $3,000 4V4 per cent school building bonds, dated Juno 1, 1897. All of those bonds aro now payable at tho option of tho school district. Tho new Issue of funding bonds, bearing 4 per cent, Is pnynblo July 1, 1001, optional after July 1. 1!)05, at tho discretion of tho district. Principal and Interest will be pay able at tho First National bank of Chlcngo, which Institution Mr. Bechtel represents, The bank holds nil tho bonds of tho $40,000 Issue, dated June 1, ISO.'. A manual ex chnnco of the bonds will bo mado In tho samo manner that tho city recently re funded Its outstanding Indebtedness, which deal was consumatcd by Mr. Bechtel. Under the old law, ull bonds Issued by school districts becamo payable nt any tlmo after Issue, but under tho now statute nil school bonds are for ten years. It Is In order to obtain longer tlmb bonds that tho First National bank of Chicago Is willing to accept bonds nt a lower rate of Interest. Owing to tho fact that Indebtedness of tho school district Is up to tho constitu tional limit, the new Issue of funding bonds ennnot be placed on the market for sale, but can only be exchanged for old bonds, which they refund. Undor the call to bo Is sued by the treasurer of tho school dis trict, all Interest on tho old bonds will cease after July 2, or such date as tho ex change Is made. Mr. Bechtel Is to receive $175 for tho necessary expenses of the Issue of tho now bonds, supplying the blanks, etc., when tho transaction Is completed. By funding tho outstanding bonds at 4 per cent the dis trict will save over $3C0 per annum In In terest. No action was taken by the board last night looking toward tho building of the new High school nnd It Is understood thnt noth ing further will be done nutil tho thirty days In which an appeal can be taken from the selection of tho old school site have expired. Ah soon as the thirty days have expired, If no appeal Is taken, tho work of erecting tho school will bo commenced and pushed forward as rapidly as possible. Tho case grows out of tho estate of John M. Day. who died In Des Moines In 189G, when the original law was In force. After his death the collateral Inheritance law (or Its manner of enforcement) was doclarcd unconstitutional and an amendment was hecurod.
