In the opinion of the city attorney the Barber Aspbnlt company may bo forced to play the role of a public benefactor to the extent of $24,000 , representing the contract price of the Cumlng street pavement. The laying of the pavement was complete * ! this wrek , the strip extending from Thirty-sec end to Fortieth streets. The contract was lot In accordance with an ordinance based on a petition of property owners. There was doubt at the time , however , whether the petition represented a majority of the frontage of abutting property. On the north side of the street the llemla park frontage extends from Thirty-second to Thirty-eighth Direct , this property being exempt from tpatlon. The park was there fore not represented In the list of petition ers and waa not Included In estimating a majority 01 ironi icei. In providing that paving ran only bo laid upon a petition of a majority of properly owners , however , the law malttfl no excep tion In favor of public grounds or other ex empt territory. The city attorney thinks It possible , therefore , that the park must be Included In the estimate of frontage and In that case the petition would fall short of securing a majority of front feet. The pavIng - Ing ordinance may accordingly bo null and % old , and In case bonds were Issued they may be held worthless by the courts. The Investors would then hold the city rcsDonsl- ble and the latter would necessarily either raise the amount by general taxation or re pudiate Its obligation. CoiitriiotiirH * Kyon Arc OIIPII. Thcao points were brought to the attention of the contractors at the tlmo the ordinance was passed and they undertook the work un der no misapprehension. The contract and bond were vetoed by the mayor for the reasons named and the city attorney sub mitted au opinion expressing grave doubts as to the validity of the ordinance. The city attorney advised the council to defer the matter of Issuing bonds until the legality of the contract has been established. His re port was adopted. TUP property owners are therefore looking forward "cheerfully to the prospect of enjoying a new pavement laid without any expense to themselves In discussing the situation Mr. Conncll ex pressed no sympathy for the IJarbcr Asphalt company. Ho said that the price at which the bid was let was $2.09 a square yard and that a moro recent bid was $2.39. Formerly such work was done at $1.57 , with a good profit , It IB said , and In the city attorney's opinion there is sufficient margin In the present prlco to Include the risk of Invalid ity of contract. Ho adds that the contrac tors went Into the matter with their eyes open and that If anyone Is to hold a sack It ( should not be the city. W. C. Drake , superintendent ol the Barber Asphalt company , was uncertain what stepa. If any , would bo taken In the collection of ; the money due. C. K. Squires , who has the matter In charge , Is seriously 111 and no ac tion will bo decided upon until his recovery. The payment was provided for In the last salary appro priation ordinance , but thus far few claim ants have made their appearance. There were 228 registrars employed , three at each of the eoventy-six precincts. Each of these served three days at $3 per day , the total amount duo being $2,052. The secretary of the school board has also been having difficulty In disposing of the warrants drawn In faror of Judges and clerks of the school board election. There were 532 mich officials each entitled to $3 for services rendered. Although the money has been accessible for two weeks there arc still fifty warrants uncalled for.
