The city of Omaha was victorious yester day morning ; In n case which has been con tested with more or less activity In the dis trict court for over ten years. The case was entitled Louisa Boyd against the City ol Omaha , and Involved the possession of tin north half of the lot at the northeast cor ner of Ninth and Howard streets. The clt ; has claimed the title to this property , bu Its claim hns been contested by Mrs. I3oyc and Mrs. Elizabeth Whltcslde , both of when claimed title from n former pretended owne ; and also by right of possession. The casi has dragged through the court for over tei years In one form br another , with the claim. ants holding possession In spite of all effort : of the city to dislodge them. The case , which was decided In favor o the city by Judge Powell yesterday morning , was one In which Mrs. Boyd sought an In junction to restrain the city from ejecting her from the premises. This was tried at the last term ot court , the plaintiff setting ui the claim that she had been In open ani undisturbed possession for over ten years nnd also that she had acquired title by pur chase from the rightful owner many yean ago. The city contested both points and the decision of the court sustained the po sition of the city. City Attorney Conncll stated , after leav ing the court room , that ho would at once Instruct the sheriff , under writ of ejectment Issued by the court , to remove the claimants from the houses , and would also Instruct the building Inspector to nt once tear down the two old houses which have long been landmarks. Mr. Conncll also said that this action would be followed by Immediately re quiring all parties occupying property be longing to tbo city , except these holding leases or deeds from the city , to at once vacate such property. The city now holds leases with about seventy-five parties , who have for years been ojcupying vacant lota or parts of the streets or alleys ot the city. Thcso leases have been entered Into within the past three years and give the city the right to take possession of the property at any lime. The proposed action on the part of the legal department of the city refers only to those parties who do not hold leases or deeds to parts of the public domain oc cupied by them.
