Lewis Ungcr Is to bo charged with arson , the police having decided to file such a com plaint against him yesterday. Ungcr was the occupant of the house at 1111 North Twenti eth street , In which a flro was discovered early Thursday morning , bearing the marks of the Incendiary's torch , evidence 1ms been obtained which makes the police con fident of a conviction. The evidence so far discovered flatly con tradicts the statement made by Ungcr Thurs day , when ho said that ho left the house Wednesday night about 9 o'clock and did not return until the next morning at 7 , after the fire occurred. Ho said that ho spent the night gambling In Council Bluffs , naming a number of joints which ho visited. A detective was sent to Council Bluffs Thursday afternoon to Investigate the story. He went to the houses which Ungcr stated ho visited. The proprietors told the detective that I'ligcr had not been In the houses Wednesday night at all. They had not seen him for two weeks. Moreover , four residents In the vicinity of the house will swear that they saw Ungcr In and about the house until 11 o'clock Wednesday night. They visited the station during the afternoon and positively Identified Unger. Finally , there Is one man who says that he saw Ungcr running across the street from the house a few minutes before the lire , but ho Is of that class of witnesses who are never positive. " 1 am morally certain that It was Ungcr , " he says , "but for fear that ho might not bo the man , I would not swear positively that he was the same fellow. " The fire was not cntlicly unexpected. Three days ago Detective Dempscy warned Flro Chief Rcdcll that ho might expect n nro at the house. The chief visited the premises , but did not BCD his way clear to preventing nre. Detective Dempsey shakes his head mys teriously when asked why ho warned the chief. The grounds for his suspicion may como out In the trial. Ilo simply says Unit the nre occurred sooner than he expected It. It Is undcr&tood that the mayor proposes to take the posi tion that the odlce becomes vacant on the first Tuesday In July and that Wlnspear's salary stops at that time , no matter when his biieessor Is confirmed. The case Is not altogether without precedent , as the same point was raised when Major Furay retired In 1894. At that time Furay held over for porno wreks. Section 104 of the charter re lating to the Board of Public Works simply says that the terms of members of tbo board shall bo three years and does not specifically slate whether they shall hold over until their successors are appointed nnd qualified.
