In Urn George Morgan case tire court sus. talned Judge Scott In denying a transcript of iho rccorda of the lower court , which Morgan had asked for without pay. Morgan wns convlctcd In the district court of Dougian county for the murder of 11tUo Ida Oaskill and sentenced to be hanged , Igor the purpose of presenting to the supreme court error proceedings , to have thic Judg- meat reviewed , Morgan requested the die- trict court to direct Its shorthand reporter to malco out and deliver to him gratuitously a longhand copy of the shorthand notes of the evidence in the case in which Morgan had been convicted. Ile cupported this appllc.a- tlon by his alndavit that ho was unable , by reason of his poverty , to pay for the longhand - hand copy of the evidence. " The supreme court decides that , under the circumstances. It devolves upon the Judge of the criminal division of the court in and for Douglas county to fix a new date far the execution of Morgan. In the cnro of hoover the decision of the court requires no postponement of the date for his execution , already fixed by the supreme court for August 7. The provision of the statutes declared tin- constltullonal by the supreme court to found in sectlon 49 of chapter 19 of the Itevlsed Statutes. The section la In two parts. The drat requirce the court reporter to furnish stenographic records of all proceedings to any party interested , upon the payment of a fee of 5 cents per 100 words. The second part requires him to , furnish such record , In criminal cases where , after conviction , the defendant shall make an afdavlt that he Is unable to pay for the same. The second part of the provision was ndded to the section by an amendment approved - proved In 1879. The supreme court decides that the added provision Is unconstltutlonal on purely technical grounds. The constitution - tion on this point recites explicitly that "no law hall be amended unless the now act contain the section or sections so amended and the sectlon or sections so amended shall be repealed. " In this case the legislature , which passed' the amendment In 1579 , neglected to comply with the above provision.
