The trial of Jens M. Ilcrtnnnson tor tlio killing of John Stnrostka was commenced It the criminal court Jesterclay. On December 30 , 1895 , John Starostka vUltcd tlio saloon at the corner ot Seventh nm Kcavenworth streets , where he became , drunl ami quarrelsome. Ho li il some trpublc , real or Imaginary , with the bartender , Jens M Ilermansnn , and tlio two linil a dispute Hcrmanson says that Starostka made a move'as If to draw a revolver , and that he then picked up a broomstick about clRhtcet Inches long and struck Starostka over tlio head with It and ejected .him from the saloon. About a week afterward Starostka died and Hcrmannon was placed under arrest charged with manslaughter. At tlio autopsy It was develop that tlio victim had a skull of unusual thinness and that a crack had been made in It by a blow , the crack extending for a considerable distance , and II was stated by physicians , at the time , thai death resulted from the blow , The defense take the position that the blow Inflicted by Hermanson was not sufficient to crack tlio skull and say that the Injury was received by Starostka In another fracas It Is argued that a blow sufficient to crack a man's skull , no matter how thin It might be , could not bo struck with a light stick such as a broomstick. A Jury was secured shortly after the noon adjournment yesterday , the panel being as follows : John S. Doty , W. J. Carruth , Wllllr Coy , It. A. Dubols , P. W. Pitch , Archer Eke , E. D. Dalley , William Munccke , C. W. Scamman , Carl Kochs , W. D. Rule and II. U. Wetherel. NATURE OP THE INQUIUY. Dr. Lord was called to the stand ani testified to having been called to attorn : Starostka at the .hospital end having as sisted at the autopsy. He wag unabla to tell whether the Injured man was rational before death , owing to the fact that ho spoke Polish and the witness could not tell what ho was saying. Ho described his condition before death and told about the autopsy. When the ocalp was removed and the upper part of the skull taken oft It was found that a crack had , been made In the skull by some blunt Instrument , extending from the left Pldo of the head downward to the canal of the ear and thence diagonally down and back toward the basa of the brain. The skull Itself waa'found to bo only about onaislxtoenth of an Inch In thickness , about half the thickness , " bf the ordinary skull , and was transJucqn't/ _ , The next wltnes's was Andrew Hammer , who raid he was In.tlio saloon at the time Stnrostka entered.He heard Starostka and Hermanson having d dispute about the pay ment for pome l > be"r and hoard Starostka swear at Hermansdn and call him names. John Ryan , an employe In the freight depot of the Union Pacific , testified that he went Into Hermanson's saloon about noon of the day of the quarrel. Starostka was there with or.o of his countrymen and was standing at the bar disputing with Ilcnnanson about the payment for a can of beer bought In the morning. Ryan's testimony was largely cor roborative of that of the last witness , except that he said It was Hernianson who said , "I'll fix you , " and not Starostka. Ho was very positive that the stick Identified by the last witness was not the ono Hermanson used when ho struck ! Starcstka. He said ho took particular notice of the stick and de scribed It as "a rough , unhewn stick , about eighteen inches long and about as thick as a lorije man's wrist. " Detective Dempsey testified to having hunted for Hormanson three or four days and having finally found him at Fifty-first and Pierce streets. The witness went to Hermanson'a place of business' , his rocm and his usual haunts and was unable to flnd him at any of these places. Durglars made a clean sweep of the resi dence of C. II. Sobothor , 1507 Lothrop street , last Saturday night , but a considerable portion tion of the stolen property has been re covered. The entire family left the residence dur ing the early evening and did not return until almost 11 o'clock. As Mr. Sobothcr turned to his residence ho noticed a gleam of light escaping from one of his windows. As the house was approached , however , the light suddenly vanished. When the house was entered n scene ot devastation was presented. Apparently every thing In sight that was ifot nailed down had been carried off. All the lighter bedclotuing was gone , clothing of other description had vanished , and tne house had even been stripped of the lamps. The kitchen had also licen visited and the cooking utensils had been stolen. Later In the evening a motorman , G. Braves , reported to the police that a big bundle , the outside' coyer of which was a bedspread , "was llpg against a coal shed In the rear of his residence , 3707 North Seven teenth street.
