This was practically tM de- clslon reached by the district bench yesterday - day -afernoon after a conference which t lasted for several hours. This action was brought about by the . fling oC two motions with the clerk oC the ; district court by the defense , one In the I Case oC the state against James Ish and the other In the case against label E. ish , ask- Ing for the transCer. The allegations on 1 which the motions were based are as follows - lows : "The lion. C. n. Scott , the judge holding the docket upon which thlt case has been placed for trial , Is prejudiced ) against this defendant to such a degree that this defendant cannot hove a fair and impartial trIal In this case before Judge Scott. The lion. C. n. Scot has . PI eJulced this case and has determined In his own mind upon the ( lefendant's guilt an.l ha j determined to jvork the conviction oC tub I defendant : the lion. C. n. For obilous reasons the attorneys for the deCense were adverse to disclosing their ) contents and the judges were not minded to I . disclose their nature. I Is understood , how- ' ever , that the affidavits contaIn little more than Is already : known to the 11 bl e. In ; general they alflrni that on several occasIons . the JUdge hag male rulings and supported them with reasons which indicate . that his mind Is firmly mode up as to the guilt oC the dofendante. On the last hearing for a - continuance especially Judge Scott refused to consider certain portions oC anlavls that were olrel In support oC the motion. These portions tended to show the InUmacy which I existed between Chapplo and Mrs. Ish , and Judge Scott excluded them on the grounds grounls that they were Immaterial. Shortly after the filing of the motions the mater was brought to the attention oC Judge Itopewehi. lie at once InCormaly called the bench together , and In the afternoon the JUdges assembled In Judge hiopewehl's prI- . vate office. The affidavits were carefully gone over and otter a conCerence which lated for several hours the judges called In County Attorney Ualrhige and Informed him 3 that they had decided to hell a hearing on f the motions this morning In court room No 3 at 10 o'cloclt. Notices to thIs effect were sent to Judge Scott and to the attorneys who had brought the motions. Judge Scot was not seen after the decision - I cision had been rendered , but he spoke on ' ' the mater while the conference was going on. The judge Ball that the whole matter mater , was a political scheme , and he was severe In the criticism oC his fellow judges for can- sllerLng the 10ton. "They have taken two cases Cram my ! I docket time Bennett case and the Rosewater ! case " said the judge. "Uut I am getting trell oC It and they will have soma trouble In taking this case. In time criminal court yesterday the case of Fran Woolson , colored , was called for : trial. The complaining witness Is Mary Ker- rigan , , who hIves at G13 North Twenty-first street. Late on the night oC September 7 lrs. . KerrIgan was on her way here , and at time corner oC Eighteenth and California streets she was met by Woodson. Woodson suatched a hand bag which she was carrying , and as the woman held fast to It , sue was thrown to the ground. Wolson succeeded finally In obtaining the bag and made oft with It. A Cow hours later he was found In a saloon at Twelfth and Davenport streets b ) . Detectives Savage and Dempsey ) with the stolen satchel I contained about $5 worth oC valuables and money. lIe was convicted. During the row Shannon's left ankle was broken , Special Ofcer Culen was kicked and badly bruised , and North was cut and bruised about the head and face. The police made no arrests Shannon , who was discharged about ten Into the saloon shortly after days ago , came shorty aCer 9 o'clock and bean to abuse North , who hall taken his position. Iroprletor Garrity stepped In and attempted ; to hold Shannon , but he proved too light a man to accomplish his purpose. Garrity Shannon end North rolled on the floor together - gether , and the fight became mixed. At this Juncture Pat Forth , Jr. , took a hand In the affair and gave hIs aid to Shannon. Then all hands In the bar room pled In and the blows felt rapidl ) - and Indiscriminately. There were at least twenty.lve men on the leer pounding and hammering each other to their ' . heart's content. Special Ofcer Culen attempted to arrest Ford and Shannon but was thrown on the leer wihout much ceremony. lie \ulell snatched Cram him , hi" club , but It was away anti he was left to the mercy of the gang to be kicked and pounded as the fighters willed. Several women across the street blew their police whistes , but Culrn was left alone with : the lob , A boy was sent to all the telephones In the neighborhood . but the owners positively refused to have tholr 'phones used to cal time pollee.
