demand continuing and the offerings being
light , the advance under the circumstances

the middle of the session , began to buy ribs
nnd took about 1,000,000 Ihd. and lleasloy
took about 2.0,000 Ilia. Compared with la't

LINCOLN , March 21. ( Special to The
Hee. ) Late last evening the supreme court
handed doun an opinion In a case of ex
treme Importance to every city of the bccond
class In the state. It Is the case arl&lng
out of the attempt of the city of Fremont
to Impose an occupation tax upon the West
ern Union Telegraph company. The com
pany resisted the collection of the tax on
the ground that U was a corporation doing
an Interstate commerce business , and , there
fore , was not amenable to any local or
municipal laws. The district court decided
that the city of Ficmont had the right to
Impose and collect the taTho supreme
court afllrmcd the decision of the lower
court.
The opinion Is a lengthy ono and was
written by Chief Justice Norval. In con
cluding the opinion he sajs'o have no
hesitation In holding that the ordinance of
the city of Fremont In no manner places a
burden on or restriction upon Interstate com
merce , nor docs It tax the agency of the
federal government. The ordinance ex
pressly excludes from Hi opeiallon all gov
ernment and interstate business. The
plaintiff In error could transmit messages
relating to governrticnt business and carry
communications from this state to points
In other states and to persons and places
within this state unmolested and without
paying to the city of rremont a cent as
license tax therefor. * i * * The judgment
of the district court. Is right and is therefor
affirmed. " '

an Increase of about 2.BOO cattle , whllo bogs
have fallen off some fir > 90 head and shiop

This cattle market was rather slow mil
generally easier. llccelpts were not at all
excessive , but they were nniplo , and with
bearish reports from other markets all
classes of bujcrs were more or less Itullf-
foietit. Shippers were hit hard last wuek ,
and for this reason the heavier grades of
steers were neglected. Sellers found It
dllllcult to get a decent bid , and In most
cases were satisfied to get rid of them at
prices all of a dlmo lower than Thursday.
The fair to good light and medium weight
steers were In the best demand and sold at
very llttlo less money. IMW grade stock ,
however , had to sell lower and was hard to
move. There was very little life to the
trade , but a continuous * movement resulted
In n tolerably uarly clearance.
The market for co\\n was not much
changed ; If anthing prices were a shade
firmer than Tucsdiy , There were vscarcely
twenty loads on sale and buyers for loc.il
