Gleason and J. J. Hathaway as to which shall represent the Third ward in the city council that hns not been known heretofore. It was expected that the trial of the case would take ulaco before .Imlge Smith , and a number of witnesses were summoned. Among them was City Cleric Xurmuehlon , who wus instructed to bring with him to the district court room the poll boolc and the ballots cast in last spring's election. Ever since election they have boon scaled up , and although it was suggested that possibly the Judges and clerks might have been guilty of the same neglect in certifying the returns as they wore in last tairs election , no one count do anything more than guess. In cato they had played the same trick , the sumo legal questions now being propounded In the con test over the ofllce of sheriff would again come to the front. Yesterday the city clerk , .iflor receiving his summons to appear in court , fished up the poll boolc from an obscure corner of his ofllce safe and tore open the envelope to see what it contained. In turnimr to the last pages ho felt a thrill of democratic glee when he saw that the judges and clerks had really forgotten to sign the certificate or oven to carry out thn results In ilia blanks provided for that purpose. In this precinct Oloasou received 15S votes and Hathaway 111 , BO that the discovery of the stupidlt.y or negligence of the board of election placed in doubt , a majority of lorty-boven good votes that Gloasou had in this product. The interesting thing about the discovery Is that of thu live members of the election board In last spring's election , three also held positions of a like nature in last fall's election , and they all made the same mis- lake in each case. The members of the board wore made the subjects of a great deal of good uutured raillery yesterday , and at least one of them Is talking seriously of leaving the city. City Cleric X.unnnehlen made Ills boasts , when the first discovery was made , thut If ho had spent the after- iiooir"aud evening In tlio voting place this lime as ho did in the spring there would have been no trouble. Yesterday's develop ments filled his soul with a lugubrious feel ing , and covered his countenance with n look of abjuct < humility that might have been scraped off with a luili'o. On account of the sickness of Alderman Hathaway the case had to bo postponed until next Monday , so that for the present the public is snared the anguish of having two election lights going on at the same time in the same court house , ItOTll MAKlNti A VlUUUUUa FKillf. The iuestion | of admitting the poll book and the ballots from the First precinct of the Third ward was the one which occupied most of the time in the Scanlan-ilazen contest - test yesterday.
