stead of permitting Its conductors to
do this , it should Instruct them to take the

The board of commissioners of the West
ern Trafllc association mot today and , judg
ing from the amount of business to bo dls-
prscd of , It Is nrobablo that the mealing will
bo prolonged until the end of thu week.
Among the matters to bo considered is the
organization of n pool to regulate the tralllo
from Hutchlnsoti , Kan. This subject was be
fore the advisory board of the association nt
Its lust meeting hi Now York ami was
referred by It toils commissioners for settle
ment. At Hrst It was Intended that the
division of ttiolr traflloshould bo confined to
salt shipments , but It was afterward decided
thnt the pool should embrace nil kinds of
freight. This was made necessary by the
refusal of shippers to permit these shipments
of salt to bo diverted from the lines over
which they were billed.
Another cuso to bo heard is the complaint
ngalnst thoUurllngton road , which is charged
with issuing unauthorized larilfs on wool.
Sevcr.il other interesting matters are to
come up for consideration Including the ques
tion is the division of the ihrouch rates to
bo allowed the Indiana , Illinois & Iowa road

river anil eastern points )
Passenger men are chiefly interested in
the outcome of the Keel : Island's appeal from
Chairman Finloy's decision relative to the
jurisdiction of the Western Trafllo associa

Judge Wnkploy Pastes on the Stradn-
inanl AHphalt. Court Is'olo * .
There Is nothing now that will prevent the
Stradamant company from paving the South
Omaha streets with the Utah asphallum , as
Judge Wakoloy has limited the permanent in
junction nnd given notlco that the com
mon council may enter into a conir.ict witli
the company.
Some weeks ago the oouncll asked for bids
for paving certain streets. In duo time the
bids were opened , and at the time It was dis
covered that the Stnulunmnt company had
knocked out all competitors. Some of the
nronorty owners raised llio question of tho'
quality of the material , und n temporary re
straining order was Issued by Judge-
Wakeloy.
The court discussed the question fully nnd
held that the council had authority to enter
I'ntoa contract with any company having ma
terial to soll.pi'ovldlng tlmt the company's bid
\viw the lowest nnd it entered into bonds for
tlio completion of the work us provided by
the ordinance * . The quality of the Utah
material was touched upon. It was r.o doubt
mi experiment to somti extent , but ho was of
the opinion that it would stand the Nebraska
cllmuic. It had been used in San Francisco
and had given good satisfaction. Not only
this , but on Dearborn street in Chicago an
Intersection had been ii.ived with the Utah
product. There the tralllo WHS heavy and
the imvemoiit tiad stood the test.
DflTerent men differed In their views on
puvumout , nnd each class of material had its
champions , nnd would as long as pavumenU
wore laid. This ulono would not provo that
any certain class of material was good or
bad.

that particular. It was contended by a rival

of the property owners along the streets
proposed to ho uavrd Wore not in

out off f..OOO feet frontage , 8,000 or two-
thirds favored and uigncd for asphalt. The
records also showed that but a small pro
portion of the property owners who protest
ed know the difference between th Utah
and the other grades of asptmlt. The con
clusion wui that It was for thu boil interests
of the city that the council should cuter into
n contract with the lowest bidder , nnd again
that competition was n nc.cosslt ) as it would
be detrimental to the Interests of the com
munity for any company lo have n monopoly

In Judge Ferguson's court arguments wore
continued In cnso of David K , Thompson

The Injunction case that arises on account
of the proposed change of grade of the north
