liconse Thero wero present Mayor Simpson Councilmen Brummond Buchol Bul lock Dexter Degner Uhlo and Viele In addition to thoattornoyshoretofoio appearing In tho case W M Robertson was present as counsel for tho Antl Saloon league acting in conjunction with Georgo L Wliitham Tho introduction of Vlazneys petition maiked exhibit A was objected to by tho remonstrants on the ground that no proper foundation was luid that it does not Ehow to have been signed by 10 free holders and further does not show a majority of tho freo holdeis of tho First ward Judgo Barnes in behalf of Vlaznoy took exceptions to this objection and quito a protracted discussion took place between tho attovnoys as to tho relative force of tho gonoral statues antl tho city ordinance as governing in this matter Judgo Robortson took tho position that while tjio statues are gonoral for tho state nnd counties thoy contemplated that cities of this class must pass ordi nances which should bo supromo within tho limits of tho corporation as long as thoy did not coufiict with tho stato law These ordinances must bo all good or all bad If a part is abandoned all must bo Ho contended that tho ordinances wero passed in good faith by precoeding coun cils and wero intended to bo operative Tho present city ordinanco relativo to tho salo of intoxicating liquor plainly says that an npplicant must havo a peti titiou signed by at least S50 resident freo holders Ho further argued that the city council was as supreme in its legislation in regard to allairs within the city limits as tho legislature was within tho limits of tho stato Tho coun cil who passed tho ordinanco fixed tho number of freo holders necessary on a saloon petition at SiO It was only fair to presume on their intelligence and knowledge of the law Against this view Judge Barnes quoted at length from tho general statues and very emphatically denied the correctness of tho position of his opponent From his point of view tho law of tho stato plainly stated that in cities of this class where thero was less than 00 resident freo holders in n ward a saloon petition was valid when it was signed by a majority of them Ii tho case of Vlazuey more than 21 free holders had signed Thero being only i resident freeholders in tho ward this was a clear majority and that was all the law contemplated City councils havo no right to pass ordinances that conllict with tho general statues They must comply with such general law of tho stato as in force Tho city cannot compel compliauco with an ordinanco that demands a de parture from tho general laws Tho design and purpose oftho ordinanco was merely to make provisions lor tho carry ing out of tho law already on the statuo books After tho arguments had been pre sented by tho counsel on both sides it was moved by Bullock nr d seconded by Brummond that motion bo overruled On roll call Brummond Buoholz Bullock Degner Dexter aud Viele voted aye Uhle not voting Tho motion was declared carried Exhibit B uotico of publication was objected to by remonstrants on tho ground that no proper foundation was laid and that notice attached to affida vit does not show that it was a proper notice Motion made that this bo overruled prevailed six votes cast being ayo The remonstrants further objected to exhibit C bond for saloon license claiming that no proper foundation had been laid and for the further reason that said bond was filed on first doy of May 1800 Objection was promptly overruled by the council C Walker was then sworn as a w the remonstrants and asked if Vczney had blinds or screens at his door or windows of his saloon At this point Attorney Barnes made an objection to tho signatures of G L Witham and C G Somers to tho ro monstrants as neither of them wero residents of tho First ward nnd there fore had no right to appear as protest ants Viele nuulo a motion to overrule Bar nes objection It was lost by tho fol lowing vote Ayes Bullock and Violo Nays Brummoud Bucholz Degner and Dexter A motion was then made by Dexter to reconsider and carried Bmmmod casting tho only negative vote Mr Walker was then allowed to givo his testimony Adjournment was taken until 7 50 Friday evening when tho caso will bo continued Public interest is now alivo to tho proceoduro of tho council and every evening sees more or loss hot stuff pass between tho nttornoys anil tho members of tho council which is appre ciated by the increasing number of spec tators The outcome cannot well bo forecast Tho remonstrants are evidently prepar ing to cany tho caso up to the higher courts and unless Vlazuey withdraws his application that is where it will probably end Whichever way tho council may decide an appeal is likely to bo taken Sturgeon is tho piano man Wo havo it nice a line or
