MURDER IN SECOND DEGREE
Continued from 4th Page
they were going to come at him
again and when he found they did not
he put on his clothes and went out
and was asked by Milliman if he could
go and he told him he could that he
then walked down the street with
Milliman and went to the citv mar
shals office and delivered himself up
to the authorities that he afterward
went back to his home with Hooton
and that Hooton looked at London
who was unable to speak and then
went after a doctor Thompson staid
to watch London that he staid for a
short time that it was cold and he
went to his saloon and lit a light and
a cigar and waited until Hooton and
Dr Compton came along and then he
went back to his house with them
London was then taken to Dr Hols
claws office and his wounds dressed
On cross examination he testified that
London and another soldier by the
name of Shields had been at his
housebut any reference to what took
place there was not permitted by the
court as the defense refused to go in
to the matter and therefore the state
could not question defendant legard
ing his relations with London and
Shields or anyone else which the state
claimed he was guilty of practicing
a disgusting and unnatural vice with
THURSDAY
The whole day Thursday with the
exception of a short time in tne

by the attorneys going over the case
for the benefit of the jury
Judge Harrington ruled with the

jurist and with fairness to the defend
ant His instructions to the jury
were admitted by attorneys for the
defense to be in fairness to their cli
ent
The jury then went out and after
an all night session returned a ver
dict Friday at 630 am of GUILTY
OF MURDER IN THE SECOND DE
GREE The sentence for this verdict
is imprisonment for not less than ten
years or during life in the disci etion
of the court
Motion for a new trial will be heard
next Wednesday
The defense will probably carry the
case to the Supreme Court
Thompson is in the custody of the
sheriff pending the order of the court
The attorneys in this case made ex
cellent pleas Attorneys for Thomp
son were active and thorough in their
line of defense but no less vigoroi s
was the prosecution
