was charged with stealing from their range -on Fair field creek about the first of -October five head of cattle valued at 140 or thereabouts the property of McNair Kief of Arabia and Joe Yeast of Valentine Ed Clarke assisted Coun ty Attorney Waleott in the prosecu tion while J W Tucker and H S Ridgeley of North Platte conducted the defense McNair was the first witness and testified to the ownership of the cattle when they were first missed the brands and marks and how he found them at Carrs place in Keya Paha with the brand a TJ inside a circle changed to a flying V He also told of seeing George on the range a few days prior to the theft Joe Yeast next testified to his owner ship in the cattle and said no one had authority from him to move same from the range Jetton T Kief was called and describ ed his -cattle and brand FJ on right side and- told no- when found at Carre the brand had benn obliterated with a window sash Testified fur- v tber that cattle never left rauge ex cept in a storm James McElderrys testimony was was proncipaily comborafave of the above Olivet Jaioreaux of Rosebud res ervation told of buying four steers and a heifer from George about October 9 for 100 paying for them with a check ou Springview bank which check he produced He des cribed the cattle as those stolen Mr Carr was called and told of Lamoreaux leaving four hjal of cat tle at his place near Springview while on the way to the railroad and said the cattle tound by Kief and McNair were the same Lamoreaux left there Mr Horton corroborated Carrs tes timony regarding the leaving of cattle and taking away Here the state rested Edmond George was called in his own defense His story was as fol lows On October 4th he and Eugene Meyers starteu for the Colombe ranch and on the way met Chris and Dave Colombe about 16 miles from the state line While they were conversing one Joe Cross came up driving five head of cattle After a little dickering George purchased the cuttle paying 180 dollars therefor 15 of which he borrowed from Chris Colombe Cross gave him a bill of sale writing it on paper laid on notebook on the ground He did aot notice the brands on cattle and the bill of sale did not give the brands Took the cattle to Colombes ranch and sold to Lamoreaux as I ro id but the Cclombe boys and that George did not buy receive nor drive any cattle while he was with him in direct contradiction to Gemges testi mony Strenuous efforts were made by the defense to -seep Meyers from testifying but to no avail After ar gument by counsel the case was given to the jury at 4 p na yesterday Judge Walcott made an especially good plea to the jury and is entitled tie stealing case and it occupied the to congratulations from the county at large for his condnctt of thft case As we
