braska as hereinafter sot forth in full
are submitted to the electors of the
State of Nebraska to be upon
at the general election to be held Tues
day November 3 A D 1896
A joint resolution proposing to
samend sections two 2 four and
flye 5 of articlesix 6 of the vConsti
tution of the State of Nebraska relating
to number of judges of the supreme
court and their term of office
Be it resolved and enacted by the
Section L Tliat section two 2 of article
six 0 of the Constitution of the State
of Nebraska be amended so as to read as fol
lows
Sections The supremo court shall juntil
otherwise provided by law consist of Jive
5 judges a majority of whom shall be neces
Bary to forrp a quorum or to pronounce
a decision -It shall have original jurisdiction
in cases relating to revenue civil cases in
which the state shall be a partv mandamus
quo warranto habeas corpus and such
appellate jurisdiction as may be provided by

Section 2 That section four f4 of article
eix C6 of the Constitution of the State
of Nebraska be amended so a3 to read as fol
lows
section 4 Tne Judges of tho sunremo

state at large and tjjeir term of office ex
cept ns hereinafter provided shall be for a
period of not less thin five 5 years as the

Section 3 That section five 5 of article
six 6 of tho Constitution of the State of Ne
braska be amended to read a follows
Section 5 At the first general election to
be held in the year lW thoro shall be elected
two 2 judges of the supreme court one
at whom shall be elected for a term of
two 2 years one for tho term of four 4
years and at each general oloation there
after there shall be elected one judge of
the supreme court for tho term of fivo
5 year- unless otherwise provided bv
law Provided that the judges of the su
premo court whoso terms have not expired
at the tine of holding the general elec
tion of 1SS3 shall continue to hoid their
office for tho remainder of the term for
which they were respectively commis
sioned

article six of the Constitution of the
State of Nebraska relating to com
pensation of supreme and district court
judges
Be it resolved by the Legislature of the State
of Nebraska
Section 1 That section thirteen 13 of
article six 0 of the Constitution of the State
of Nebraska be amended so as to read as fol
lows
Seo 13 The judges of the supremo and
district courts shall receive for their services
such compensation as may bo provided by law
payable quarterly
The logislature shall at its first session
after the adoption of this amendment
throe fifths of the members elected to
each house concurring establish their
compensation Tho compensation so es
tablished shall not be changed oftener
than once in lour years and in no event unless
two thirds of the meinbara elected to
each house of tho legislature concur
therein

pensation of the officers of the executive
department
Be it resolved and enacted by the Legislature
of the State of Nebraska
Section 1 Tint section twentv four 24
of article five j of the Constitution of the
State of Nebraska hs amended to read as fol
lows
Section 24 Ths officers of the executive
department of the tuale government shall
receive for their services a compeiKasion
to be established by law which shall Lc
neither mcri rsed nor diminished during the
term lor which thv shall luvc been com
missioned and they shall not rejeiro to thoir
own use any fee coais interests upon puulie
moneys in their hands or under their control
perquisites of office or other compen
sation and all foes that may here
after be payable lr law for services
performed bv an officer provided for in
this article shall be paid in advance into the
state treasury The legislature shall at its
first sesion at frr tho adoption of this amend
ment three fitths of the members elected to
each house of tho legislature con
curring establish the silaries of the
officers named in this article The com
penation so established shall not be changed

ture of the State of Nebraska
Section 1 That section one of article six
6 of the Constitution of the Staie of Nebraska
be amended to read as follows
Section L The judicial power of this state
shall be vested in a supreme court district
courts county courts justices of the
peace police magistrates and in such other
courts inferior to the supreme couit as may
be created by law in which two thirds of
the members elected to each house
concur

6 of the Constitution of the State of
Nebraska relating to increase in num
ber of supreme and district court
judges
Bs it resolved and enacted by the Legislature
of the State of Nebraska
Section 1 That section eleven 11 of
article six 6 of the Constitution of the State
of Nebraska be amended to read as fol
lows
Section 11 The legislature whenever two
thirds of the members elected to each house
shall concur therein may in or after the year
one thousand eight hundred and ninety seven
and not oftener than once in every tour years
increase the number of judges of su
preme and district courts and the judical
distiio a of the state Such districts shall
be fotned of compact territory and
boucaed by county lines and such in
crease or any change in ths boundaries
of a district shall not vacate the office of any
judge

remain inviolate but tho legislature may pro
vide that in civil actions nvo sixths of the jury

than twelve men in couris inferior to the dis
trict court

ture of the State of Nebraska
Section 1 That Beotion oue 1 of ar
ticle five 5 of the Constitution of the State
of Nebraska be amended to read as fol
lows
Section L The executive department shall
consist of a governor lieutea ant governor
secretary iostate auditor of public accounts
treasurer superintendent of public in-
struction attorney general commissioner
of public lands and buildings and three
railroad commissioners each of whom
except the said railroad commissioners
shall hold his office for a term of
two years from the first Thursday after
the first Tuesday in January after
his election and until his suocossor is
ejected ana qualified Each railroad com
missioner shall hold his office for a term of
three years jbegiuning on the jfirst Thursday
after the first Tuesday in January after
his election and until his succes
sor is elected and qualified Provided
however That at the first general elec
tion held after the adoptiou ox this amend
ment there shall be elected three railroad
commissioners one for the period of one
year one for tho period of two years and
one for the period of three years The gov
ernor secretary of stiite auditor of pub
lic accounts and treasurer shall reside at
the capital during their term1 of office
they shall keep the public records boolcs
cud papers there and shall perform such du
ties as may be required by law

Section 23 No other executive state offi
cers except those named in sei tion one 1
of this article shll be created except
by an act of the legislature which is
concurred in by not less than three fourths
of the members elected to each house
thereof
Provided That any office created by an
act of tho legislature may be abolished by
the legislature two thirds of tho mem
bers elected to each house thereof concur

Nebraska providing for the investment
of the permanent educational funds of
the state
Be it resolved and enacted by the Legisla
ture of the State of Nebraska
Section 1 That section nine 9 of articlo
eight 8 of the Constitution of the Stato
of Nebraska bo amended to read a3 fol
lows
Section 9 All funds belonging to the state
for educational purposes the interest and
income whereof only are to bo used hall
be deuine 1 trust tuuds held by the state
and the statft shall supply all losses there
of that may in any manner accrue so that
the same shnll remain forever inviolate
and undiminished and shall not be in
vested or loaned except on United States
or state securities or registered county
bonds or registered school district bonds of
this state and such iutids with tha inter
est and income thereof are hereby solemn
ly pledged for tho purposes for which they
are granted and set apart jmd shall not
be transferred to any other fund for other
uses
Provided The board created by section
1 of this article is empowered to sell from
time to time any of the securities belonging
to the permanent school fund and invest
the proceeds arising llierofrom in any of tho
securities enumerated in this section bear
ing a higher rate of interest whopever
an opDortunity for better investment is pre
sented
And provided further That when any
warrant upon the state treasuier reg
ulnrly ismed in purauam e of an appropri
ation the legislature and secured by the
levy of a tax for its payment shall
bo presented to tho state treasurer for
payment and there shall not be any
money in thy proper fund to pay such
warrant tho board created by section 1
of this article nriy direct the state treas
urer to pay the amount due on such war
rant from moneys in his hands belonging
to the permanent school fund of the state
and he shall hold said warrant as an in
vestment oc said permanent school fund

section to article twelve 12 of said
constitution to be numbered section
two 2 relative to the merging of the
government of cities of the metro
politan class and tho government of
the counties wherein such cities are
located
Be it resolved and enacted by tho Legis
lature of the State of Nebraska
Section 1 That article twelve 12 of the
Constitution of the State of Nebraska bo
amended by adding to said articlo a new sec
tion to be numbered section two 2 to read
as follows
Section 2 The government of any city of
the metropolitan- class and the gov
ernment of the county in which
if is located may be merged wholly
or in part when a proposition so to do has
been submitted by authority of law to the
voters of such city and county and re
ceived the assent of a majority of the
votes cast in such city and also a majority
of tho votes cast in tho county exclusive
of those cast iu such metropolitan city at such
election

manner in which votes shall be cast

such other method as may be prescribed
by law provided the secrecy of voting be

State of Nebraska relative to donations
to works of internal improvement and
manufactories
Be it resolved and enacted by the Leg
islature of the State of Nebraska
Section 1 That section two 2 of articlo
fourteen 14 of the Constitution of tho
state of JNeurasfca do amenaea to reau a3
follows
Sec 2 No city county town precinct
municipality or other subdivision of the
state shall ever ranks donationi to any
works of internal improvement or
manufactory unless a proposition so to
do shall have been first submitted to tho
qualified electors and ratified by a two
thirds vote at an election by authority of
lawi Providod That such donations of a
county with the donations of such subdi
visions in the aggregate shall not exceed
ten per cent of the assessed valuation of
Buch county Provided further That any
city or county may by a three fourths
vote increase such indebtedness fivo per
cent in addition to such ton per cent and
no bonds or evidences of indebtedness so
issued shall be valid unless the same shall
have endorsed thereon a certificate signed
by the secretary and auditor of state
showing that the same is issued pursuant to
law

Cora A Jarrett upon the southwest quarter of
section 34 township 33 range 37 west to secure
the payment of a certain promissory note dated
March 4 1893 for the sum of 10000 due and pay
able in one year from date thereof That there
is now due upon said note and mortgage the
sum of 11500 for which sum with interest there
on from this date plaintiff prays for a decree
that defendants be required to pay the same or
that said premises may be sold to satisfy the

ARTICLE I NAME
Section 1 Thenameof this organisation shall
be the W J Bryan Non Partlsau Free Silver
Club
ARTICLE II OBJECT
Section l The object of this organization
shall be to disseminate a silver sentiment a
better understanding of the finance of the coun
try among its members and the people of tha
county generally and to promote good citizen
snip by purity of purpose and harmony of action
and to work for and secure by honest efforts the
election of W J Bryan as our next President
ARTICLE HI OFFICERS 1
Section 1 The officers of this club shall be a
President Vice President Treasurer and three
Secretaries
ARTICLE IV COMMITTEES
Section 1 There shall be an Executive Com
mittee composed of the officers of the club to
arrange ail preliminaries of the campaign and
to fill vacrncies when such occur It shall be
the duty of this committee to scale a program
for each meeting
ARTICLE V FUNDS
Section l All funds for necessary expenses
shall be raised by voluntary contribution only
ARTICLE VI RCLES
Section 1 Roberts Rules of Order shall gov
ern the meetings of the club
