r .f- ' Unconstitutional.
I , I..INCOLN-Sugar beet bounties are
unconstitutional. . So declared JUdge
.
' Cornish III the district court , and he
/ ; ' sustained the demurrer of the attor-
ney general , who argued that the suits
i. . Dr the Oxnard Sugar company and the
. I - Norfolk Sugar company ought to be
ll1SIUlsscd. The two concerns asked
.
l. . . for more than $50,000. .
. The claims of the companies have
t.
" peen before successive legislatures and
. . . permission was given at the last ses-
. .
I. 310n for the sugar manufacturers to
IUO the state and establish the validity
_ of their claims.
The companies claim that the state
promised a bounty of 1 cent a pound
! n 1885. Between the years of 188.1 !
and 189 . the companies claim , $1,000-
.
UUO.was invested , with the understand-
tug that bounties would be paid. The
. . .
act was repealed in 188.1 ! , but the com-
panies claim that three.quarters ot a
cent was voted to foreign companies
In 1895. After the bills were audited
the attorneys for the companies state
that the officials refused to pay , asserting -
3ertlng that the state lacked fundEr.
They argue that legislatures have endorsed -
dorsed the claims and the last one directed -
rected that suit be brought.
Attorney General Prout argued that
sugar beet raising was not a public undertaking -
dertaldng and that the legislature had
10 right to appropriate public money
for such a purpose. The court upheld
his contention. 1'ho case may be ap-
penled.
