To Make More Clear
It has been intimated to the writer
that perhaps the account cf the Macy
Rebman case in last weeks issue might
not be clearly understood- We stated
that the case ended in favor of Macy
Practically this is correct As we stated
bofore after murdering his wife J
Frank Conners placed his two ohildren
in the keeping of his brother-in-law and
sister Mr and Mrs A L Macy who
were also charged by Conners with the
care of the property Subsequently
Macy and wife sought to secure adop
tion papers on the boy in question the
little girl having died last summer
This application came up before County
Judge Moore who denied the applica
tion Macy and wife still retain the
boy unber the verbal authority of the
father who is now serving a life sentence
in the Nebraska penitentiary The
mother of the murdered mother Mrs
Lucy M Rebman some time since
sought to secure guardianship papers
over the child in Oberlin Decatur coun
ty Kansas in which she was success
ful Good legal advice however ques
tions the legality of a resident of Kan
sas being guardian of a minor Nebras
ka Upon Mrs Rebmans return to
Cedar Bluffs Kansas Macy forcibly
took the child from Mrs Rebman At
the recent trial in this city Mrs Reb
man applied before County Judge
Moore for temporary possession of the
child but the application was denied on
the grounds that Mrs Rebman is a resi
dence of Kansas and the child a resi
dence of Nebraska
As the matter now stands Macy and
wife are in possession of the child and
property and probably will retain poss
ession until a court of proper jurisdic
tion appoints an administrator of the
property and a guardian for the child
