Must Appear in District Court
Squire Berry had a case from Indian
ola before him Monday The title was
Tho State of Nebraska vs Charles II
King and the matter involved a small
strip of land along the east side of the
town site of Indianola and between
site and the addition of tho Li n
Land Company
Charles II King recently bought
some of this land from the land company
and fenced ofT what had been used as a
street or road plowing up the same
William Plourd as complaining wit
ness brought the action for obstructing
and plowing up a street or highway and
many witnesses from Indianola appeared
to testify in tho case
While it was shown that the street
had never been legally and formally laid
out and dedicated the evidence indicated
that it had been used for thirty years as
a highway and was generally regarded
as a street or highway in fact
On this theory tho squire held tho de
fendant Mr King to the next term of
district court under a bond 8200 which
was provided by Mr King
