MAN IS FATALLY WOUNDED Brother of Man Killed Fires a Shot Which Ffnshes the Outlaw Five Murders to McKinneys Credit Most of Them Cold Blooded Crimes BAKERSFIELD Cal The long ond existing pursuit of James Mc Kinney the outlaw from Kingman Ariz ended in a battle with the offi cers of the law within a few blocks of the business center of the town Sunday two men being killed and one fatally wounded The killed JAMES MKINNEY outlaw WILLIAM TIBBETS deputy sher iff Fatally wounded Thomas Packard city marshal The battle took place in a large two story brick building on the out skirts of Chinatown used by the Chinese members of the Sui Ong Tong as a lodging house opium den and joss house Here McKinney had been sentenced for two or three days He had a companion Al Hulse an ex jconvict who being a member of a Chinese secret society was enabled to lenlist the aid and sympathy of the Orientals in harboring the outlaw Shortly before 11 oclock Sheriffs Kell of Kern Collins of Tulare and lLovin of Arizona with Officers Will and Burt Tibberts Gus Tower and i City Marshal Packard surrounded the house in which McKinney was known to be hiding Will Tibbets and Packard ap proached and ordered the outlaw to surrender McKinney answered by Shooting Will Tibbets was shot through the stomach and died short ly after Packard was shot through the neck and shoulders and danger ously wounded Burt Tibbets a brother of the dead deputy sheriff shot McKinney through the mouth and neck killing him The house was a regular fortress McKinney had a sawed off shotgun in his hand while Hulse used a pistol Hulse would not obey the order to surrender and the fire department was ordered to the scene Hulse then surrendered He was taken to the county jail Another accomplice of McKinney was known to be in the house whero the battle took place but he would not surrender The builing was set on fire and in fifteen minutes the man who refused to give his name was smoked out and taken to jail The feeling runs very high against Hulse the evidence tending to show hat he is the man whose bullet killed Deputy Sheriff Tibbets GIVE OMAHA LOW GRAIN RATE Western Lines Will Carry Wheat to the Gulf for Twenty Cents CHICAGO After considerable op position western traffic men on Mon day consented to allow Omaha a dif ferential of 4 cents above Kansas City on a proportional through rate from that city to tie Gulf to apply on grain The rate it is said will be taken but on May 15 and permits wheat to move from Omaha to the gulf for 21 cents and corn for 20 Lines Ibat were promoting the rate insisted that it had become necessary to clear out Omaha which is said to be glutted with grain The Nebraska lines were against the proposition presumably because they preferred to carry he grain east to Chicago CANT DISARRANGE PROGRAM President Will Not Spend Day in Black Hills CINNABAR Mont No news has been received from the president since he left early Friday morning for Nor rls in the Yellowstone to view the geysers As the trail had been made passable in the worst places it is sup posed that he reached his destination safely During the last two or three days of his stay in the park the president will be joined by President Loeb and the other members of the party The plan for the president to spend a day in the Black Hills has been abandon ed owing to the impossibility of dis arranging the program as already ar ranged An hour will be spent at Edgmont where the president will be given an old fashioned cowboy recep tion He Came From Texas WASHINGTON D C Lieutenant Howard who the deck and with it went the spars sails and gearing in a confused mass of wreck age The yachts decks were crowded with Sir Thomas Liptons guests of ficers and men and it seemed a mir acle that the disaster was not attend ed by serious loss of life Deprived of its chief support the immense steel tubular mast swayed for a frac tion of a second and went overboard creating general havoc as it fell mentally and with but an instants hesitation is dead aged 20 years About a week ago he wzs taken to the state hospital suffering from a severe mental strain believed to be the result of his work and assignment of the salary warrants of William OBrien county attorney of Platte The supreme court says that the assignment of the salary or fees of a public officer to be earned in the future is contrary to public policy and thereiore void H E Will living west of Falls City drove a fine young horse hitched to an almost new buggy to town and tied the horse to a hitch rack in the bus iest part of town from which place the rig was stolen A reward of seventy-five dollars has been offered for the arrest and conviction of the thief and return of the property Much interest is manifested at the Union stock yards at South Omaha in a report just issued by the government bureau of animal industry on the sub ject of blackleg in cattle The report says that cattle losses from this cause aggregate easily 6000000 annually The bureau is sending out to appli cants for it a vaccine to be used in case of blackleg Recent orders issued from Grand Army of the Republic headquarters at Lincoln announce a considerable num ber of posts delinquent for per capita tax and that many of them have not yet sent in their lists of delegates for the department encampment to be held at Fremont next month The order also invites bids for the next state Grand Army of the Republic re union State Superintendent of Schools W K Fowler went to Holdrege to consult with the county superintendent of Phelps and adjoining Wheat Shows Well and Farm Work Advances LINCOLN The first bulletin of tho climate and crop service says The first decade in April was warm with beneficial showers on the 10th in the central and eastern counties the rainfall exceeded an inch in a few counties along the Platte river but was generally less than half an inch Farm work progressed rapidly Oats sowing Is nearing completion in south ern counties and Is well advanced in northern Some early sown oats are up nicely Spring wheat Is nearly all sown and in some places the acreage will be considerably less than last year Grass and fall sown grain are starting nicely Winter wheat is gen erally in good condition although In some places it has been winter killed in spots In the southern counties rain would be beneficial to wheat Tho Jessel a German fanner living a few miles east of town were in town after a physician to attend to the injuries received by his daughter Minie at the hands of her father Jessel struck her on the back
