Assembly
SENATE
In the senate on the 14th among the
ills Introduced were the following To
provide for the payment of fees to the
commissioners of public lands and build

Hall of Douglas proposing amendments
to sections 2 6 and 13 of article 4 en
titled The judicial department of the

This resolution amends the clause in sec
tion 2 article 6 relating to the number
of supreme judges and defining a
Quorum It strikes out the number of
judges and leaves it to the discretion of
the legislature They can appoint any
number they may see fit It changes the
method of selection of the chief justice
set forth In section 6 article 6 and re
quires his selection by lot In place of
tenure of office It also amends section
13 article 6 which states the salary su
preme Judges are to receive and leaves
the salary to be decided upon by the
legislature
Senator Hall of Douglas presided during
the morning session of the senate on the
15th Pembertcn of Gage read a bid from
Dora Bachelor to furnish the senate with
daily Journals for 300 for the entire ses
sion and she was awarded the contract
The committee on municipal affairs at a
meeting decided to report favorably on
senate file No 1 In regard to the pur
chase of the Omaha waterworks Intro
duced by Howell of Douglas These bills

When the senate opened on the 16th
Mr Hasty offered the following I
move that the committee on revenue be

instructing the committee to recommend

which the resolution was tabled Pri
vate Secretary Allen brought a com
munication from the governor asking
confirmation of the appointment of a
warden at the penitentiary Hall of
Douglas moved to Instruct the commit
tee on printing to have the messages of
the two governors printed for the use
of the house and senate A motion was
carried to have the committee confer
with the committee from the house Hail
of Douglas moved that a request be sent
to the governor for the Torrens land
tax commission and his recommenda

Roll call showed all present in the
senate on the 19th when it reconvened
from Fridays adjournment President
Harrison temporarily left the chair and
offered the following resolution Re
solved That the revenue committee for
the senate be and is hereby directed to
hold Itself in readiness to confer with
and act In conjunction with any com
mittee designated by the house of rep
resentatives to act in a similar capacity
to the end that such joint committee
so constituted may without delay take
under consideration all measures sub
mitted to it by either house looking to
tffectlve amendments to the present law
or the entire revision of our revenue
system and shall after due delibera
tion promptly report to the respective
branches of the legislature of which it
is a part recommending for passage such
measure or measures as in ils wisdom
will bring about the desired result The
resolution went over one day The chief
clerk of the house brought a communi
cation that the house had concurred with
the senate In regard to printing the mes
sages of the two governors He brought
with him H Rs Nos 22 and 160 and
these were read a first time The sen
ate went into executive session and con

HOUSE
In the house on the 14th a large number
of bills were Introduced among them be
ing the following A bill for an act to
protect the public health to prevent the
Spread of contagious and infectious dis
eases and to this end to confer sanitary
authority upon and to define the powers
and duties of state board of health and
of the secretaries thereof to provide for
the appointment and compensation of a
state health inspector to authorize es
tablishment maintenance and enforce
ment of quarantine rules and regulations
to require local officers to make timely
reports of the existence of certain dis
eases to make an appropriation for
salaries and expenses and to provide for
presecutlon and to fix penalties for the
violation of the provisions of this act
Authorizing courts of record county
courts or courts of probate in the state
of Nebraska to appoint as administrator
executor guardian or curator of the es
tate of any deceased person infant In
sane person idiot spendthrift or habu
ual drunkard or as trustee for any con
vict In the penitentiary or as receiver
In any legal proceedings any savings
bank of the state of Nebraska A bill for
an act to compel railroad companies In
Nebraska to afford equal facilities with
out favoritism or discrimination to all
persons and associations erecting or op
erating grain elevators and handling or

ter the coup de grace to the elevator
monopoly by requiring railroads to fur
nish elevator facilities to all applicants
a bill to create the office of county
auditor and a number of bills for tne
collection of delinquent taxes and the
perfecting of tax titles
Immediately after the house convened
on the 15th Sears of Burt called up his
resolution of the previous day that no
building appropriation bill should pass be
fore the enactment of a revenue law He
made a speech In Its support and moved
its adoption After considerable discus
sion It was moved and carried that the
resolution go over to Friday becoming
special order for that day Bills from 61
to 85 were given their second reading and
referred to committees and thirty nine
new ones were introduced among them
the following An act providing for the
taxation of telephone and express com
panies requiring- an annual statement to
the state auditor of value of stocks and
bends and all personal and real property
and empowering the auditor to demand
any other information imposing a fine of
100 per day for delay of statement pro
vides for valuation by state board of
equalization An act to amend section 12
article 1 chapter ii Compiled Statutes
making it mandatory on county boards
to pay county agricultural societies by
warrant on general fund not exceeding 3
cents per capita in county Act provid
ing for making six wells in the state of
Nebraska for the purpose of determining
whether petroleum coal or gas exists and
can be gotten in paying quantities and
appropriating the sum of 30000 or so
much thereof as necessary wells to be
located at Chadron Lexington Culbert
son Columbus Ponca and Omaha Act
to authorize the organization of mutual
insurance companies for protection of do
mestic live stock An act providing for
deputy county superintendents and fix
ing their duties and compensation by
county commissioners not to exceed two

The house on the 16th presented the
request of the Lincoln Commercial club
for the use of representative hall the
afternoon and evening of January 22
when a public reception is to be tendered
to D E Thompson prior to his depart
ure for Brazil The request was granted
Sears of Burt called up his resolution
to prohibit public building bills from
ccmlng to a third reading prior to the
passage of a revenue measure Mem
mlnger of Madison moved to amend by
excepting from the purview of the reso
lution repairs and rebuilding of public
Buildings The speaker ruled the amend
ment out of order until the motion of
Sweezy of Webster to refer to the ju
diciary committee had first been disposed
of On the motion to refer Sears de
manded the yeas and nays The vote re
sulted Yeas 7 nays 6 The question
then recurred to the Memminger amend
ment which was lost by a rising vote
of 42 ayes and 43 nays On the adoption
of the resolution Sears demanded a roll
call The vote resulted Ayes 78 nays
17 The speaker announced that the res
olution had been adopted adding The

says The result of todays proceed
ings serves to substantiate the theory
that revenue leglsltalon will not be
Ignored at this session Leading ex
ponents of this policy in the house are
well satisfied and even enthusiastic in
some cases over the progress of affairs
and give evidence of a firm belief that
their idea wil achieve complete success
The Introduction of the Douglas resolu
tion is highly gratifying to Mr Sears
and his friends Sears said today I
am glad Douglas Introduced the reso
lution If he or someone else had not
I would have done so myself for I con
sider that the proper way to get at the
matter I regard the resolution there
fore as in direct line with my efforts
Attorney Baldwin of the Union Pacific
discussing railroad taxation said We
do not say we are paying as much city
taxes proportionately in the city of
Omaha as other individuals or concerns
We are actualy paying less but as a
matter of fact that is right Wo are
paying all we ought to pay It would
manifestly be wrong to make our city
taxes in Omaha equal in rate to other
taxpayers Omaha Is not entitled to as
sess for local taxation the terminals
within the city limits at their full cash
value
Both houses adjourned from Friday un
til Monday The second week was an
extremely busy one and the third is ex
pected to be still more so A great deal
of real work already has been done and
the foundation laid for a long steady
grind In the house 143 bills have been
Introduced and In the senate fifty six
These measures many of them havo
been given their second reading and
are being placed In the hands of the
committees which will get down to
work immediately and soon have some
of the bills back in the houses where
they originates for further disposition
Regarding revenue legislation Speaker
Mockett said I have no doubt that
the necessary legislation will be enacted
along this line I think there is no dis
position or desire to shirk this or any
other duty But I am of the opinion
that our greatest need in the line of
amending our revenue laws lies in the
matter of providing adequate means of
enforcing our present statutes I do not
know why this would not meet the de
mands fully and satisfactorily I am of
the impression that our revenue laws
at present are not so bad as some
might imagine and I believe the greater
number of thoe people who are familiar
with these laws will agree with me
when I say that we need a better en
forcing clause and not a completely new
set of revenue statutes There may be
some revisions that could with profit be
made I do not care to speak finally as
to that
John Wall chief clerk of the house
is confined to his room by illness and
it is feared it may be protracted If so
it brings up a question of a serious na
ture with reference to the work of the
house The chief clerk is the man who
signs the bills in the house and it is
not just clear in case of his physicial
inability to perform this duty what dis
position would be made Whether the
law would permit the first assistant
chief clerk to sign in place of the chief
clerk does not seem definitely settled
An opinion from Attorney General Prout
will be asked in case the emergency
arises
Old members of the legislature and
veterans of the lobbies who have watch
ed the workings of many Nebraska leg
islatures say none ever showed greater
business symptoms at the outset than
the present one Apparently there is no
disposition on the part of any to pro
long and put off what can be done
now but the prevailing sentiment evi
dently is to facilitate the machinery of
lawmaking to every possible degree
Fusionlst membership consists of
twenty four in the house and four in the
senate
Senate file No 1 by Howell of Douglas
has been approved by the senate as a
committee of the whole and ordered
engrossed for a third reading This is a
bill to compel the city council of Omaha
to purchase the water works plant of
that city
Another revenue resolution has been
introduced by Harrison of Hall county
It provides that the revenue committee
of the senate hold itself in readiness to
confer with a committee that may or
had been appointed by the house on
any revenue measure that may come be
fore it The object of the resolution is
to prevent the house and senate from
working along different lines

apples They have also worked up

Mrs Peter Johnson of Elm Creek
left home with another man Lee
Smith by name who hails from Colo
rado He husked corn for Johnson
last fall They drove from Elm Creek
to Overton to take the train for Den
ver but were apprehended She re
turned home on the condition that
Smith should be released which was
done
At a mass meeting of the repre
sentative citizens of Hastings held in
the courthouse it was decided to in
struct the mayor and city council to
accept Mr Carnegies offer of 15000
for the erection of a public library
and the mayor and council were au
thorized to levy a 2 mill tax to raise
the sum of 1500 annually for the
maintenance of the public library
J E Nance who lives about ten
miles southwest of Adams committed
suicide in a horrible manner He
went into the smoke house where
was kept coal oil and poured the fluid
over his head and clothing and then
set fire to the oil He rushed out of
the smoke house all aflame and ran
across a cornfield until he dropped
dead in a ditch
Deputy Labor Commissioner Basseti
has received a letter from Secretary
of Agriculture Wilson notifying him
that W D Collyer United States in-
spector of dairy export has been as
signed to attend the meeting of the
dairy association in Lincoln February
22 23 The presence of Mr Collyer it
is said will lend much interest to the
meeting and he will be asked to judge
the exhibits
Frank Baird who was arrested a
few days ago for robbery near Bursay
Iowa formerly lived in Plattsmouth
He is an ex convict having gone to
Fort Madison Iowa in 1894 for two
and a half years for counterfeiting
Before returning to Iowa it is said
that he shipped his household goods
to Creston and then set fire to the
building he rented and collected S500
insurance on his household goods
A rumor is current in Beatrice that
the Union Pacific is considering the
advisability of moving its shops from
Beatrice to Marysville Kan The re
port however is not confirmed by of
ficials of the road
Joseph Tschauner sr was killed at
the approach of the Platte river bridge
at Osceola He was coming honxe from
Columbus and one of his horses be
ing slower than the other on going
up the approach the wheel struck one
of the rails and Mr Tschauner was
thrown out and instantly killed I
