DISTRICT COURT In addition to the three cases decided last week and reported in the-e columns , up to the time of our going to press this week the following cases have been dis posed of : The replevin action of David Carpen ter vs. The Citizens Bank of McCook was decided in favor of the bank defendant , with special findings in which the plain tiff agrees to release from the mortgage a certain stallion. The action in appeal brought by The McCormick Harvesting Machine Co. vs. Hiberd E. Waugh was decided by the jury , after lengthy consideration , in favor of the defendant Waugh. The action in replevin of P. T. Francis vs. H. H. .Mitchell was decided by the jury 7n favor of plaintiff , to whom dam ages were given in the sum of one cent , the costs of suit going to the defendant in i the case The Crabtree-Archibald case was con tinued over to next term of court to give the prosecution time and opportunity to amend. The damages suit of T. C. Kelley vs. Alice Peters resulted in the jury giving Kelle } ' damages in the sum of one cent , and the parties to each pay their own costs. The jury brought in a verdict of not guilty in the state of Nebraska vs. Wilj liam Porter. This was a case of alleged assault , appealed from the county court , and concluded the jury cases at this term of court. The case of the Citizens Bank of Mc- Cook vs. C. F. Babcock , involving the collection of taxes under distress warrant - rant , was taken under advisement by the judge. } The appeal case of Red Willow county vs. the estate of A. H. Barnes , involving some $240 excess fees collected and not turned over to the county , the defendant was given 30 days to prepare brief , and the : plaintiff 30 days in which to reply. COUNTY COURT. Suit on note was filed , this week , by G. B. Wolford vs. C. O. Haleet al. Case to be heard next month. Rittenhouse & Boyle have commenced au action against William Schmidt for professional services rendered.
