THE governor has appointed as the
Live Stock commissioners under the new
law Messrs. J. 0. of Sa

These gentlemen are all old residents
of the state , are experienced farmers
and stock growers and are known as
clear headed and energetic citizens.
They will undoubtedly make an ener
getic board of commissioners. A state
veterinarian remains to be appointed but
the selection will be made in a few days.
There are numerous applicants for the
position. Lincoln News.
-E. ROSEWATER'S testimony in his
libel suit against the Omaha Republican ,
indicates that he was about the same
kind of an operator during the rebellion
that he is a republican at this later date.
Rosy blandly remarks that he manipu
lated the electricity for the confederacy
at Nashville as long as the confeds. helc
that'city , but that after its evacuation
by the southern forces , and the union
army occupied the place , he wasn't like
the fellow who couldn't flop , so he
quickly proffered his valuable services
to the victorious unionists. "Consisten
cy , thou art a jewel , " but thy name is
not Rosewater , nor is the surname there
of Edward. The jury awarded Edwarc
one hundred dollars to ease his injurec
feelings.

On motion the contract to build said jail was award
ed to J. B. Teas at his bid , and to be built according
to plan and specifications submitted by him. Said
contractor to file bond in the sum of $2300.
SPECIFICATIONS Building to be 24x34 feet and
21 feet high from foundation. First story to be 14
Inch hollow wall 11 feet hisb. Second story to be 10
Inch hollow wall 10 feet high. Hip roof raising 7 feet
and covered with shingles. Lewer story to be plas
tered three coats. All wood work to be painted three
coats. Examination of assessments continued during

Educational Land Laws.
EDITOK THIUUNK :
In view of tho fact that tho last Legislature
of this State passed an Act relative to the sale
and leasing of the lands of this state , taking ef
fect June tho Sth , 1885 , which repeals all laws
in conflict thereto , and in view of the further
fact that I urn acting as County Attorney for
several counties in Southwestern Nebraska ,
In whlch'tho people are materially effected in
this now law , and who are desirous of being in
formed thereon , I therefore submit for publi'
cation the following as my opinion given on the
construction of said act :
Tho main object of this law seems to bo to
provide : Finsi. For tho sale of educational
lands owned by the state. SECOND. For tho
leasing of such as do not sell. This is dono by
the co-operation of tho Educational Board of
the State and tho Board of County Commis
sioners of the county in which the lands are sit
uated. In the application of said law , wo must
not blend tho functions of these two boards.
* By section two of tho new law , it is made the
duty of the Commissioner of Public I/ands and
Buildings under the direction of tho Educa
tional Board of the state to prepare abstracts
in book form of all Educational lands owned
by tho state.
By section three it is made the duty of tho
Educational Board of the state , when these ab
stracts have been prepared , to forward to the
Chairman of the Board of CountyCommission-
ers or Supervisors , as tho caso may be , of tho
county in which any of these lands may bo sit
uated , a list of such lands. Tho Chairman of
the Board of County Commissioners can do
nothing without this list , for the lands arc not
in shape to bo placed on the market until ho
has received it. After the Chairman of the
Board of County Commissioners has received
a list of tho lands in his county , they can then
bo placed.on tho market by order of the Edu
cational Board of tho state , that said lands be
appraised for sale and lease. But tho Educa
tional Board of the state is not required to or
der tho lands appraised until they receive a
petition signed , by not ICES than one hundred
tax-payers and residents of the County , asking
that said lands be appraised for the purpose of
sale and lease. This petition mustbe approved
and certified to by the Board of County Com
missioners that tho Educational Board of the
state may know that the one hundred signers
are tax payers and residents of tho county in
which tho lands to ho appraised arc situated.
After the order of appraisal has been passed
by the Educational Board of the state , it then ,
and not until then , becomes the duty of tho
Board of County Commissioners , oramajority
of them to go in person and upon actual view
thereof , to appraise said lands in their county ,
together with the improvements thereon , and
return a correct value of said lands under oath.
Tliis appraisement must be entered upon a rec
ord book of their proceedings , and then must
be by them returned to the Commissioner of
Public Lands and Buildings , whose duty it is
made to enter the same upon the abstracts
kept in the office : upon the receipt of the ap
praisement aforesaid , it is made tho duty of
the Commissioner of Public Lauds and Build
ings to prepare aud furnish tho County Treas
urer as a record of all sales and leases made in
his county.
Each and every one of the foregoing require
ments must 1)0 complied with in every respect
before the lands can be placed upon the mar
ket at all. After this procedure has been gone
through with , then it becomes the duty ot the
Educational Board of the state to have the
lands advertised for sale by publication for
four consecutive weeks , in some newspaper
published in the county , if there be no news
paper published in the county , then in some
newspaper of general circulation , therein giv
ing the time when , and the place where , said
lands will be sold ; an affidavit that the notice
has been published for the lour weeks must
bo made by the printer and filed in the olhce
of the Commissioner of Public Lands and build
ings. After the publication of the above no
tice has been made , as aforesaid , it is then made
the duty of the Commissioner of Public Lands
and Buildings to attend such sale , in person ,
or by agent , and offer all the lands for sale by
public auction ; no person can purchase more
than 610 acres. The land can not be sold for
less than seven dollars per acre , in addition to
the improvements thereon , and cannot be of
fered for bale more than ouco a year. Incase
the Commissioner of Public Lauds and Build
ings docs not attend tho.bulc in person the
County Treasurer acts as his agent in the salo
of the lauds.
Any person purchasing land upon which an
other has made improvements , must pay the
appraised value of the improvements in addi
tion to the price of tho laud. If the person
owning the improvements does not accept the
appraised value thereof , lie is allowed six
months from day of sale to remove them.
By section eight it is provided. "That any
person who has heretofore occupied or improv
ed any of the Educational lauds that have not
been appraised , may apply in writing to the
Board of County Commissioners to have such
lands appraised for the purpose of lease or
purchase and such lands may DC leased or pur
chased the same as other lauds under the pro
visions of this act. " This proviso does notgive
the occupant any advantage whatever , over
the general public , except that he may bring
the land which hehasso occupied aud improv
ed into market by his individual application
to the Chairman of the County Board. This
application must he forwarded by the Chair
man of the County Board to the Board of Pub
lic Lands and Buildings. The appraisement
ordered andmade. , Thu abstracts prepared by
Commissioner of Public Lands and Buildings ,
and books furnished to County Treasurer , and
lands advertised for sale in the same manner
in every respect , as before indicated , upon the
petition of tho one hundred resident tax-pay
ers asking that all the Educational lands be
placed upon the market.
Under this act , no Educational Lands can In
any event be leased until they have been offer
ed for sale , as above provided. And , if they
do not sell then they are subject to lease at a
rental of six per cent , on the appraised value ,
instead of bids on the appraised value.
Applications forthe lease of any of the lands
shall be made to tho County Treasurer of the
county at the county-seat , and not to the
Chairman of the County Board , and shall con
tain an affidavit that tho applicant is not an
owner of a lease of more than six hundred and
forty acres of state Educational Lands , includ
ing the amount called for in the application ,
and desires the lease for his own use and ben
efit. The application shall be accompanied by
the amount due as rental to the first day of
July or January , as the case may be. In esti
mating the amount of rental to accompany the
application , take six per cent , of the appraised
value. If two or more persons desire to lease
the same land the County Treasurer or Com
missioner of Public Lands and Buildings , if he
be present , shall auction the same off to that
person who in addition to the six per cent ,
rental will pay the highest premium for said
: ease , that is if A. B. and C. all make applica
tion lor the same tract of land and each appli
cation is accompanied with the six per cent ,
rental , this particular tract is auctioned off as
aforesaid , not to the man who will pay the
jighest rate per acre , but to him who will pay
the highest amount of cash money as a premi
um for said lease.
If any person shall lease lands upon which
another has improvements , the pureuuser shall
deposit with the County Treasurer the apprais
ed value of said improvements in addition to
said premium and first payment of rental for
said lease. The value of said improvements
: o be paid to the owner thereof. If he declines
to accept said amount , he is allowed six
months from date of lease to remove his im
provements.
The law does not require that the lands he
advertised forthe purpose of lease , but directs
that Immediately atter the close of the sale of
such lands as atoresaid , all unsold lands shall
> e subject to lease , and application lor the
ease ot the same shall on the samoday betak
en up and disposed of as above indicated. The
ease continues for 2o years , unless terminat
ed sooner by the consent of the lessee and
Commissioner of Public Lands and Buildings.
By section 10 , it Is made the duty of the Com
missioner of Public Lands and Buildings to
'umlsh blanks and reasonable rules and regu-
ations to carry this net into effect. Hence the
3oard of County Commissioners must be f ur-
nishcd with these blankst > rules and rcgula-
ions before any action can be required on
their part. The remaining portion of said act
not herein conbtrued , provides for the general
management Of lands und funds set apart for
educational purposes , and for tho investment
) f funds arisingirorn the sale and lease of such
