GIRL FREED FROM _ Coroner's Jury at Bluffs Finds Fatal Accident Un avoidable. Miss Nellie Mann, 19, of Elyria, O., was exonerated lty a coroner’* Jury Thursday morning of all blame for the accident In which Mrs. Bertha Callahan, North Omaha, was killed, and her husband and his father seri ously Injured In Council Bluffs on the evening of October 7. The jury’s verdict declared that Miss Mann had used all possible vigi lance to avoid the accident, which she said was caused by the slippery streets. In her statement to the Jury Thurs day morning. Miss Mann, who Is the niece of F. L. Lainson, Council Bluffs florist, said that her heavy car had begun to skid on th# wet pavement as she was driving south on South street, at the top of the hill near Washington avenue. As the car proceeded down the hill, she said, she lost control of it, and it swerved from side to side, between r the parked cars. Near Washington avenue the car leaped over the curb and into Washington avenue, in the path of the Callahan car. In an effort to cross the street in front of the Callahan car, she said, she accelerated her speed, but was unable to avoid the accident. She said she did not believe the two cars collided, but that Patrick Callahan, w ho was driving the other car, turned into a telephone pole In order to avoid a collision. if Her statements were borne out by Mrs. Helen K. Petersen, 111 Wash ington avenue, who saw the accident. She testified that Miss Mann had sounded her motor as the* car plunged dow-n the hill. The jury was otit only a few min utes before returning its verdict. Miss Mann and her uncle, Lainson, owner of the car which she was driv ing, are defendants in two suits for damages totaling $40,000 filed by the two Injured men. Both men have been confined to Paxton hospital since the accident. Death has walked the wings of planes flown by Cyle Horchem and his aviatrlx wife. Cyle Horchem,'a stunt aviator, for merly of Wichita, Kan., was killed Wednesday In a fall of approximately 1,000 feet near Pumpkin Center, be tween Tulsa and Drumwrlght, Okla. His wife, Eertha, preceded him In death, having been killed when her plane crashed March 3 last, at San Antonio, Tex., where she W’as appear lng with a flying circus. The wing of her plane crumpled as she was going Into a loop nt an altitude of 1,200 feet. Her husband and 3.000 spectators saw her plnne crash into the earth 20 feet from the hangar. The couple appeared in Omaha In November, 1921, during the Interna tional Aero congress here. Ilorchem piloted the plane from which a para chute jumper leaped to his death In the Missouri river, being tangled in his parachute. LANDMARK HOTEL ]0 BE REMODELED Eppley Buys Lindell at Lin coln; to Build New One Also. Construction will start sometime In 1925 on the new Capitol hotel In Lin coln, It was announced Thursday by Eugene C. Eppley, owner of a num ber of Nebraska and Iowa hotels. The negotiations which Eppley had been conducting since November 1 for the purchase of the Lindell hotel In Lincoln were consummated Wednesday afternoon. As soon as the legislature adjourns In the early spring, the Lindell will he completely remodeled and refurnished. The work on the Lindell will be postponed until the legislative ses sion because It Is one of tt\p haunts of politicians and lawmakers. Epyley declared that he would not start construction work o'n the Capi tol until after the changes had been effected In the Lindell. lie has pre pared no bids for the work yet, and thus estimate has been placed as to the ultimate cost of the new build ing. Plans, however, have been drawn up for the edifice. The Capitol will be six stories In height, and in some respects will re semble the Allerton houses, except that It will go' after transient busi ness. The first floor will largely be sub-rented to stores and ehops. al though there will also he a cafeteria and sandwich shop there.
