Omaha attorney* appear somewhat worried over the fact that Federal Court Report No. 299 shows several cases where Federal Judge McGee denied an appeal In liquor cases and was upheld by the circuit court of appeals. One attorney declared that Judge McGee may take the same stand he has In the post and deny an appeal to a lot of persons who have been convicted and who think they can win their case in the higher court on a technicality. The judge instructed all persons eonvicted, or those who have pleaded guilty, to appear before him next Thursday for sentence. Coroner’s Jury Holds Slavers * Leopold and Loeb Implicated in Jail Delivery; Boast They Can Escape Jail. Chicago, June 28.—A coroner's jury fc^pwln vestigatlng the death of 13-year w old Robert Franks today concurred In the action of the grand jury In indicting Nathan Leopold, jr„ and Richard Joeb, millionaires' aons, for the kidnaping and murder of the \ boy. ‘ The lnveatigatlon of the coroner's jury was reopened after it had been continued previous to the time Leo pold and Loeb had confessed that they had abducted the eon of a neighbor and killed him for excitement. Only one witness was heard by the jury today, Michael Hughes, chief of de tectives, who said the boys had told him they kidnaped and killed the Franks youth. Two alienists again visited the county jail' and subjected the boys to an examination today In prepara tion for the contention of the defense that they were Insane when the Franks hoy was slain. They did not reveal the nature of their examina tion. Extra guards were placed over the boys after Leopold was reported to have told prisoners and jailers that he could escape If he liked. Seven prisoners in the county Jail, one of them a cellmate of Leopold's, were removed to the Pontiac reforma turv today as a result of Leopold's boast that he could get out of Jail K he wished, and the Investigation which followed. s Jail officials said they bad found I a plot to smuggle pistols Into the jail, I to be followed by the starting of a fake riot and the overpowering of a guard who was expected to come to ^^kquell the disturbance. With the guard's keys the prisoners had ex pected to escape, according to jail officials, who believe that Leopold had heard of the plan. DRUGGET GOES ON LI )U0R TRIAL Emil J.
