James A. Sumner, 69, white-haired, sat in District Judge Fitzgerald’s court before a jury Thursday morning, charged with a crime against ids granddaughter, Mary Sumner, 4, 2455 South Fifth strert. "Witnesses against him were Mr. and Mrs. James Sumner, his son and daughter-in-law. The little girl, sit ting in her mother’s lap on the wit ness stand, also testified. Two letters, signed by the aged man, were read to the jury hy Deputy County Attorney Gross. Both were dated January 26, 1924. One read as follows: “Dear Wife: I am telling you good by. It would have been better for me it I had never been born. Please have them put me in a plain box and stick me off in some corner and don’t let any of the children look upon my dead face, and please tell all the chil dren never »to mention my name. “See what sin has done for me. I hope it will he a lesson to you all. I know full well that I will get my just dues for transgressing God’s law's." Tiie other letter also breathes re morse for a sinful life. It reads in part: .“James: I am not here for long, t have a dreadful pain In my leg and my conscience hurts me even worse. It scorns that a jinx has followed me all my life. I can’t stand this and just have to let God take me and mete out Justice. I feel that 1 am lost like many' other poor souls, only worse. I have suffered the pangs of remorse these many years. “I know God will surely give It fo me hard and soon. I haven't long to stay here." A statement, alleged to have been made by Sumner, sr., tb Mr. Gross, was read to the jury' over the protest »f Public Defender John X. Baldwin. Mrs. L. Lurry Dies at Home Mr*.
