City of Aurora Wins Fight for Cheaper Power *Gas and Electric Company Agrees to Lower Rates and Refund $4,000 Excess Charges. Aurora, Neb., Sept. 28.—At a meet ing of the city official* of Aurora and the officers of the Nebraska Gas and Electric company a settlement was reached in the litigation which has existed over electric rates for many months. Under this agreement the company immediately puts into effect the ordi nance rates for electricity and pays back to the consumers the funds which have been impounded in the office of the clerk of the district court of the United States at Lin coln. This amounts to about $4,000 and represents the excess charged by the company over the ordinance rates. A board of arbitration has been provided to settle the amount due the city under the profit sharing contract in the ordinance. The controversy arose over rates which the city claimed were granted for a single year during the period of h'gh prices for coal and other prod ucts used by the company. This in crease was granted at the urgent re quest of the company, but when the year expired the company continued to charge the same rates and declared it would continue to do so. The city applied for and secured a restraining order in the state courts and the company immediately removed the case to the federal court. The company at first contended that the city had no power to enter Into such a contract for rates by ordinance. Judge Munder held against this contention and referred the case to Special Master D. H. McClenahan to determine what the contract really Is. Mr. McClenahan held that the ordinance rates are the legal rates, thus supporting the claim of the city. Exceptions were filed to this report by the company and they had been set for argument before Judge Munger in Omaha. Under the stipulation of dismissal the company pays the costs and restores the old rates. Photographers Will Meet at Columbus Columbus, Neb., Sept. 28.—More than 100 photographers from the ter ritory north of the Platte river will meet in Columbus fo^ the annual convention of the North Nebraska Photographers’ club, October 1 and 2. Samples of work of all of the mem bers will be held in the Federated church Monday. The community orchestra will furnish music. Miss Miriam Anderson, Kearney, will give a program of eccentric singing. One of the unique features of the two day convention will be the total ab sence of speeches of any kind. Officers of the organization are: C. W. Craven, Wayne, president; Gus' tyden, Schuyler, vice president; L. R. Priddy, Columbus, secretary-treas urer. To Celebrate 40th Year as Pastor at Columbus Columbus, Neb., Sept. 28.—Rev. Herman Miessler, pastor of the Im manuel German Lutheran Missouri Synod church here, next Sunday will celebrate his 40th year in the Colum bus pastorate. Rev. Mr. Miessler came here from a St. Louis seminary and started with a congregation of 12 families. The congregation now numbers 125 families. Douglas-Sarpy Merger to Be Issue Before Legislature Candidates Claim Made That Sarpy County Has Not Graveled Principal Highways in Accordance With Promise Made. Annexation of Sarpy to Douglas county promises to be an issue on which various candidates for the legislature must express themselves to Douglas county voters at the com ing election. A bill providing for annexation in event more than 50 per cent of the voters in both counties favored it at a special election has been before the Nebraska legislature for two ses sions. It was killed through in fluence of Sarpy county office-holders ers and certain property owners at both sessions with comparative ease. The first bill was introduced for the avowed purpose of forcing Sarpy county to better its courthouse and its roads. Hundreds of Sarpy county residents, living In the vicinity of Pa pillion, the county seat, went in per son to the legislature carrying huge banners on their shoulders and pro testing against such a procedure and promising to build a new courthouse and improve their roads. Built New Court House. The legislature believed them. Sarpy county did build a new court house and spent a little more time in keeping dirt roads in good condition. Meantime, Douglas county was ex panding. The south side was begin ning to evade Sarpy county. Douglas county was graveling and paving its principal roads until today there is Ynore than 100 miles of graded or hard surfaced roads in Douglas county. Other counties were doing likewise, excepting Sarpy county. For in stance, the D. L. D. highway from Lincoln to Omaha is paved with ce ment from Omaha to the Douglas county line and is graveled from the Lancaster county line to Havelock where paving begins. Sarpy Officials Opposed. A bill was Introduced at the last ses sion, this time to force Sarpy county to gravel or pave its principal high ways. The county office-holders arose in arms at Papilllon. They had been instrumental in electing John R. Hughes, a South Omaha commission man, who lives over the Sarpy county line, to the legislature on an anti annexation platform. Hughes was clever. He aided the outstate members and took the com mittee on privileges and elections to Paplllion for a big dinner in advance of the ceremonies there for dedication of the new courthouse. Following the dinner, members of the committee heard speeches from members of some of the old families in Sarpy county. Self-determination, prodigous spending ability of Douglas county and local pride in the history of Sarpy county, one of the oldest counties in the state, were subjects of the addresses. Paved roads were mentioned and held out as probabili ties in the next two years. In the committee Were members likewise sentimental In a materialistic age. They returned to Lincoln and the first act of the members was to recommend the bill for Indefinite post ponement. Time Limit Elapsed.
