Assailants Get Wrong Man When Swinging Ax Dominick Caponi, Peck's hotel, hav ing dined in a Capitol avenue res taurant, was walking near Ninth street and Capitol avenue, when two men rushed from a house, one of them swinging an ax, with which iie struck Caponi on the side of the head. With a cry. “That's the wrong man," the man fled. His alleged companion. Louis Burns, 918 Capitol avenue, was arrested and is charged with disturbing the peace. Haney of Sioux City, thrust a re volver in his stomach and said, "Put 'cm up.” Haney did. "Not so high, not so high,” warned the gunman. "Juft easy like, you know.” Then he backed Haney into a doorway and took S78 in hills and *2 in silver from his pockets. While this operation was in prog ress, the highwayman continued to smile in the most pleasing manner imaginable, according to the vic tim's story to police, and when it was completed said, "I'm gone,” and sauntered off, pocketing his pistol. At the corner, he broke and ran. Haney was so dazed he neglected to report the matter to police. About midnight he appeared at the station and told his story.
