Bryan to Act on Court Martial Governor to Pass on First Case in State Under Ar ticles of War. Lincoln. Juno 2S. — Governor harles W. Bryan, as commander-ln chief of the Nebraska National guard, soon is to pass upon the action of the firm general court-martial held in this state. This is the fine imposed upon fchestev Struhlie. private In 'ompany L, One Hundred and Thirty 'ourth infantry, amounting to 150. Private Struhbe was tried on charges of disrespect and conduct un becoming a soldier and assaulting his superior officer, Capt. Harry K. Grainger of Company I. April 10, l:i2S. at the Armory in Lincoln. The general court-martial convened June 15 to hear the case, which was con tinued over until Wednesday, June 20. The trial lasted until the following lay, when Private Struhbe was found guilty of the charges and a fine of •50 imposed. Under the law the maximum sentence which could have been imposed was a fine of $200 or 200 days in jail and a dishonorable discharge from the National guard. The dishonorable discharge would have meant loss of citizenship for the • roused. MaJ. Marcus L. Potiet sat as Judge advocate general. Holding of the general court-mar tial was made possible when the 1921 | state legislature adopted ns the basis for disciplining the Nebraska Na tional guard the articles of war, which are the basis for disciplining the United .States army and which are a part of the federal statutes. The action of the legislature was pur suant to the- national defense act of 1920, under which the National guard of the United States was reorganized The articles of war provide that the actions and findings of general court-martial shall be subject to re view by the commanding general of the territory within which the court sits. In this case the commanding general, or corresponding civilian official who is given the title of com mander-in-chief. Is Governor Bryan. Storm Hits Missouri; Several Persons Hurt Joplin, Mo., Juno 2».—One man probably fatally hurt, several others slightly Injured and perhaps a dozen cities and towns in southwest Mis souri slightly damaged, with almost a score in darkness, seemed late last night to he the chief toll of a ter rific. rain and wind storm which struck shortly before ilsrk and In some sections reached tornado pro portions. Telegraph lines lnl*almost all direc tions from Joplin were down and ef porls to get in touch with outlying towns proved futile except in a few instances. The storm apparently struck its hardest blow north and northeast of Joplin, with Carthage and Webb City each being hit by a terrific gale. Large trees In both cities were up rooted. plate-glass windows shattered and ejutbulldings blown away. . 'I World’s Youngest Tourist ] Born in Bluffs to Make Trip to Bad fir Coast The world’s youngster tourist yes terday gave vent to a terrifle howl and clamored to be on Iter way. She’s the one-day old daughter of Mr. and Mrs. H. C. McGilrny of Muskegon. Mich., who are motoring to California. The couple hesitated in Council Bluffs Wednesday so that the stork could eateli up with them. "They’re both doing nicely, thanks," Mr. McGilroy said jester day. "We’ll lie on our way soon." Bert Cole, Noted | Airman, Killed A \ i a t o r anti Mechanician Plunge to Death at * Denver. Denver, June 28.—Bert Cole, wide ly known a'viator, and George Law ley, his mechanician, were instantly killed here last evening when their airplane crashed from a height esti mated at 2.500 to 3,000 feet. The pfene was in flames when spectators arrived at the scene of the crash in the east part of the city. The two flyers had been In the air about an hour, having started from the Curtis-Humphreys landing field. They had been doing stunt flying and bad headed back toward the field when the pilot evidently decided to try one more stunt. Hundreds of residents who were watching the plane saw It soar up ward. then one .wing was seen to break loose and the machine began a dive earthward. It turned* over twice in mid atr and landed on Its nose at the edge of a small corn field. Cole, the pilot of the ill fated air plane, was commissioned a captain In the 120th observation squadron of the Colorado National Guard just four hours and a half prior to his death. An hour after the time he was killed he was to have been mustered in with other officers at the armory here. Friends of the dead pilot said he was elated over Ids commission as captain and that probably the desire to celebrate a bit by doing stunts in the clouds caused him to overtax the strength of his machine, resulting In the breaking of a wing and the fatal fall. 3 Omalians on Washington List of Pensions in State Special llUputch to The Offlnh* IW.
