No matter in what form the ques tion lias been put, Mr. Rogers lias declined to answer It. Thc com missioner before whom the evidence Is being taken is without power to compel an answer, but the supreme, court possesses the nuthorlty to order "Mr. Rogers to be punished for eon t tempt of court If he declines to an swer after being ordered to do so by that court. Mr. Hadley wants this Information to show that tho three alleged sub sidiary or confederated companies aro monopolizing the oil trade of Missouri in combination and to induce the Mis souri courts to order them ousted from that state. Mr. Rogers again declined while on the stnnd to disclose the stock owner ship of tho three companies and was revcrely admonished by Mr. Hadley to treat the hearing seriously and not as "funny." Lawson Invited to Testify. An Interesting feature of the hear ing was an Invitation sent by Mr. Hcd- ley to Thomas W. Lawson of Boston, requesting him to come to Now York and testify if he can give any Informa tion as to tho three companies Mr. IluiIIoy Is trying to drive out of Mis souri. Lawson declined the Invita tion on tho ground that he had only general knowledgo of the matter. The subpoena server, who has been trying for several days to summon II. Clay Pierce to testify before the com missioner in this case, notified Mr. Jlndloy that be has been unable to pet Mr. Pierce, who. he said, had sailed away on a steam yacht. Mr. Pierce Is chairman of the board of directors of tho Waters-Pierce Oil company of Missouri mid lather of the president of that company. Lincoln, Jan. 8. -Alter a conference with Attorney Genet al Brown, Insur ance Auditor Plerco announced that fire companies In other states which have refused to pay the 2 per cent reciprocal tax, ns required by the stat ute, must pay up within a reasonable time or bo barred from doing busi ness in this state. Thirty-six fire insurance companies arc Involved. In the states in which thoy are organized Nebraska compa nies must pay a special tax, and Ne braska desires to play even. Compa nies located in Pennsylvania, Ohio, Massachusetts, New Jersey, Illinois, Wlsconson, Minnesota, Missouri ana California arc chiefly affected by this order. When the Nebraska law went Into effect tho companies brought a test case and won in the Biiprome court. Later Mr. Brown got a rehearing and tho court held that tho law was good. Tho companies immoc.atoly filed a motion for another hearing, and this matter is now pending In court.
