Xow my advice is, for the people of this County to do no such thing. As verv many of the people do not understand this suit with the Kailroad Com pany I will, witt the IIkiiald's permission, give a brief statement of the case, and my reasons for opposing this compromise. I will endeavor to occupy as little space as possible. In the iirst place the Kond3 were a base cheat upon the people, us they (the people; received nothing by their issue, that they had not already guaranteed; and the niajoritv was only obtained for the Konds by a few individuals us" ing the grossest misrepresentations during tho canvass preceding the election. From this and the clandestine manner in which the Konds were issued and delivered, de termined a few of u to test the validity of the Konds. and to this end a suit was commenced, asking the Courts to an- ! nui me joruis, wnicli upon coming before Judge Crounse, (a very good friend of It. K. monopoly; our case was dis missed upon the ground that we had "no cause of action. Keing thus so promptly non-suited, we concluded- to change our base and try the virtue of politics in the case, and through sundry maneuvers, which somewhat annoyed and finally unsettled some of the most venerable of the professional wire workers of our partv, the control of the County fell into the hands of our Iriends. The result of which was, that when the K. It. Kond interest became due. no tax was levied to pay it. Affairs ran on in this manner for two vears, and no tax was levied to pay the interest, when the Railroad Com pany commenced suit against the County to collect the in terest, by obtaining a Writ of Mandamus, commandinir the County Commissioners to levy the necessary tax forthwith to pay the interest then dtie. The Countv'Commissioners upon taking legal advice in the matter, concluded to resist tho Writ an.l proposed to defend themselves, and put in such an answer to the Mandamus, that the K. R. Co., when the case came up bafore the Court, considered themselves beaten, and upon their own motion the case was dismissed at their cost. The Commissioners then concluded to take advantage of tho favorable turn the case had taken, and to settle the matter definitely asked and obtained an injunc tion, restraining the K. R. Co. from sel'ing these bonds or j disposing of them in any way. T It AN S F E R ( j L EST 1 0 N IN CONGRESS. - "The jiresent encumbrance on travel TierooS the continent imposed on the traveling public, by the Iowa pool of railroads, called the transfer business, is proposed to be continued to all time, throh the aid of Congress. Tlie Iowa Legislature has taken i'uc matter up and her delegation in Con gress are urging tlie passage of a bill Vompelling the U. 1. to receive goods find discharge freight over in Iowa, at the end of their railroads. A question as to the proper terminus of the L". 1. K. K. has been in the courts some time and as far as any decision has been reached it has been adverse to the Iowa sid- of the question. Re fore this, however, the Legislature of Iowa passed a bill making it a criminal of- f anee for any employee cf these Kail roads to even run a train over the U. 1. bridge, or to deliver freight any where but at the end of the Iowa lines. To say that such a bill is an outrage on every other state in the Union is to draw it very mild. If each State bor tleving oil Iowa should pass a like bill the traveling community might aa well at ay at home and tlie West do without merchandise and freight from the a:a.5t. We return thanks for an invitation l!v such adjustment the Countv will be released from 81 "30,01 '0 (if I am cor rect about the accumulated interest) of indebtedness on bonds and founons outstanding, being almost threc-l'fchs l of the amount in controversey to this date. In my judgment, the Commissioners should accept this proposition; I ad vise this not because I believe it prob able that there can eventually be a re covery upon these bonds; but because all experience has shown the uncer tainty of litigation, where any doubt exists about the'law. The saving beyond contingency of so large u sum as loO,noo with interest annually to accrue to the amount of $10,000 per annum for an average pe riod of over twenty years to come, making over S-O0,0()b more, and over S"3('0,000 in all, is so great a benefit to the County, that I do not feel justified in advising it be put to the hazard of further litigation, for the chance of saying the other .100,000 and interest to accrue thereon. I thiol- -Viso that the Commissioners have a righ1; to consider in determining upon a svt-iiemeiit, that the Kail Koad in aid of which the bonds were voted, was actually built and put in opera tion and its benefits secured to the peo ple of tlie County. We also publish the letter of Mr. Pollard, who differs from the County (. ominissioners, and beg leave to say that we seldom answer it communica tion in our own paper, but shall com ment on this by saying that as far as the IIi:i:ai.i is concerned, it never told Mr. Pollard or anyone else, that the Railroad was a "liberal one or pur sued a liberal policy." Whatever bosh ! the Watrhmfin may have uttered on this head, wo, simply, fairly and short ly told the people of Cass that it was better to pay SltO.ooO now, than inter est on double that amount every year and the principal at the end of that, and we think so still. If Mr. Pollaki.s letter stated the facts, we would be the last parties to advise the County to settle, but as we are informed, the suit was dismissed "without prejudice," on account of in formality in the papers and not be cause tne iiamoaa tnougnt tney Jiau a bad case in the end. Our observations of the final decision of the Courts have all been in favor of paying bonds once issued, and the able opinion of Judge Wakely as well as that of Mr. S. M. Chapman convinced the Co. Commis sioners that they were but acting as prudent men in compromising now, be fore more expense was incurred. Mr. P. does not take any large chances in his private affairs, and must bear in mind the fact that his views as a private lnutviuuai, anu tne views oia actjnJgisje?i4 WFdnoU.i.r, or as trus tee for the interests of a County, might be very different! yet not subject such persons to suspicion. His allusion to Judge Crounse has no foundation in fact, for Mr. Crounse is, and has been.the strongest advocate we have had against the railroads, having devoted his whole energies towards getting a bill passed by the House of Representatives, forc ing them to pay their taxes, and thus relieving the tax-payers of Xebraska of a heavy burden. We are requested, :dso, to say that the County Commissioners are sur prised to learn that Kro. P. is, or lias been, engaged in carrying on the pres- that such matter was being managed by the County through its Courts and attorneys; and that in a matter of -so much importance they could not af ford to take his opinion on the legality of these bonds. We must add that in poiut of integrity and good sense the present board of Co. Commissioners will compare favorably with any that have preceeded them, judging by acts and facts.
