make a hostile move. The Japanese
ministry explains the severance of di
plomatic rtlations on the ground that
while delaying a definite answer Rus
sia was strengthening her forces and
preparing for war. The situation is
doomed critical and active hostilities
are expected by many who are keep

sions, he said:
"As ordinary constituted, these
commissions consist of one member
from each of the litigant states and
an umpire from a third state. It not
infrequently happens that the case
goes to the single umpire, who is re
quired to decide complicated ques
tions which might well tax the learn
ing of the supreme court of the United
States, even when instructed by trials
in the lower courts and by full ar
guments at the final hearing. Either
the commissioners should all be ap
pointed from third states or the num
bers of the commission should be so
increased as to include nf ion ...
