MONDAY, JUNE 3, 1935. PAGE FOUR PLATTSMOUTH SEMI - WEEKLY JOURNAL 11 ITE1S Emit Kuebn, of Fullerton, where Jie is engaged in farming, was a busi ness visitor in Murdock for the day Monday of last week. Mr. and Mrs. A. J. While Mr. Neitzel was away the store was looked after by Chris Kupke. Tuesday and has rallied satisfactor ily. Her many friends are hoping she may soon be able to return home again, restored in health. Installed New Plate Glass The plate glass which was recently broken by a stone thrown by one lad at another, has been replaced with a new one, restoring the window, but at a considerable expense, and for the third time we wish to again mention the folly of throwing stones. Two windows have been broken in a short space of time since the regraveling of some of the streets, the larger stones offering a temptation to the boys to throw at one another. Let the past be a lesson and refrain from such dangerous amusement, boys! Will Broadcast News At a meeting of the Murdock Boos ter club which was held last Tuesday, it was determined to inaugurate the practice of broadcasting news of in terest to Murdock and community, to be conducted by a young man who will be selected to devote a few min utes to this purpose, beginning at 12: SO p. m., or the noon hour, daily. This broadcast will include the weather report, news of importance from over the country and the local happenings of interest, a3 well as a brief review of the trade offerings of the business men of Murdock who are sponsoring the broadcast. This will be a matter of interest to many, and doubtless many will await the line call each day as their signal to listen in on the news. B. I. Have Beautiful Place We were visiting a short time ago while going about our work over the county, at the home of Mr. and Mrs. A. D. Zaar north of Murdock and sure were surprised and pleased at the very beautiful grounds surrounding the home. The lily pool as a center piece, was surrounded with a profu sion of tulips and other flowers that completely filled that portion of the spacious lawn. Other flowers sur runded the cuter edge of the lawn and with the roses soon to bloom, this beautiful home is a striking contrast to many umkempt places over the country which might as well be beau tiful if their owners would take the time and the pains to make them so. Wilcox, 71, passed away after an illness that has covered the past several months and in the last weeks of which he had been failing rapidly. Mr. Wilcox was born in 18 04 and for the past thirty years made his home In Plattsmouth, for a great many years being in the employ of the U. S. government as caretaker at the postoffice building, serving there until his retirement on pension several years ago. He is survived by the widow, Mary A. The body was taken to the Horton funeral home where the funeral ser vices will be held on Sunday after noon at 2 o'clock. Following a conference held at Lincoln Friday by county commis sioners and county attorneys of twenty-three Nebraska counties, an action was filed in the supreme court test ing the right of these counties in the division of the one cent gasoline tax levied for relief purposes. A number of the counties of the state have not signed with the FERA and have been denied their share of the gasoline tax funds to provide for relief In the counties of the state and to match the federal funds appro priated for that purpose. Among these counties is Cass as one of the twenty-thre and while the one cent tax is levied on the gasoline sold in the county they have so far failed to receive their share in the distribu tion to care for the heavy burden of relief. The 1 cent emergency gasoline tax for relief purposes is the subject of the main attack along with the state assistance bill. It is alleged that the house bill attempts to dele gate to the state assistance committee power to determine what shall con stitute needed assistance and for what purpose the funds collected un der the tax are to be used and what counties shall benefit thereby. It is alleged that the 1 cent tax is not general for public purposes in that counties not eligible to fed eral relief will receive no benefit oth- than old age pensions, if any. A petition being prepared for filing in the supreme court asks for a de claratory judgment, for adjudication of rights and legal relations of the plaintiffs and other taxpayers as they may be affected by the law enacted in the petition and for adjudication of the rights of counties and cities. The plaintiffs are to be five tax payers of the state, Louis Smithber- er of Stanton county, Robert Mun- derloh of Cuming county, Ernest Brock of Nemaha, Henry A. Peterson of Phelps county, and Thomas Stial of Colfax county. Defendants named in the petition are Governor Cochran, Secrtary of State Swansooy Treasurer Hall, At torney General Wright as members of the state board of educational lands and funds, trustees of state as sistance funds, W. B. Banning, di rector of the state department of agriculture and collector of all gaso line tax funds, also Frank D. Throop of Lincoln, Francis Heagey of Oma naha, Gene Huse of Norfolk, A. F. Buechler of Grand Island, Herman Holm, Frank M. CclTey and Mrs. W. J. Hotz, all members of the state! assistance committee. In addition to the three county at torneys chosen -to prosecute the suit other county attorneys will parti cipate in the work. The counties be hind the suit are Cuming, Antelope, Keith, Kimball, Grant, Hooker, Ban ner, Sioux, Phelps, Nemaha, Seward, Saline, Sarpy, Merrick, Butler, Gos per, Arthur, Cass, Dawson, Colfax, Saunders, Wayne and Stanton. These counties allege they are taxed for re lief and that they do not share in it while seventy other counties do share. In the County Court of Cass Coun ty, Nebraska.
