WORLD'S OLDEST PASSION PLAY The Frieburg Passion Play, first produced in Germany in 1264, will be presented by the famous German players at Lincoln on Thursday, Oc tober 17th at the University coliseum, under the auspices of the American Legion post of Lincoln. Of particular interest here is the fact that the chorus of the Weleyan university will assist in the musical portion of the program and among the members of the chorus will be Miss Mildred O'Brien Says Charge Against Him Dropped Writes That Governor Directed Clos ing of Deal to Trade Fish With City of Tulsa. M. E. O'Brien, fish commissioner of the city of Tulsa, Okl., writes he considers the case against him for taking 2,000 fish from a Cherry coun ty lake, as having been closed In his favor. The Nebraska fish and game commission sorae weeks ago placed the matter before the attorney gen eral of Nebraska for action. The at torney general investigated and re ported that O'Brien had violated the state law limiting the number of fish, in one's possession and the law pro hibiting the taking of fish without a permit. O'Brien's defense was that he had entered into an agreement to trade fish with the Nebraska commission and that he had not violated a law by taking fish from Nebraska waters in a federal fish car. No action has been taken by the state commission. Some members of that body admit that a tentative agreement had been entered Into but that the details had not been completed when O'Brien came and got a carload. Mr. O'Brien writes: "During the past two months the writer of thi3 article has received a great deal of publicity 'wholly unso licited,' and not what you might call complimentary. I have waited pa tiently for the final act in the drama which would call for the curtain. On Oct. 8 Commissioner Endacott and the city of Tulsa received the follow ing telegram from Warden O'Connell of Nebraska: 'In "reply to your let ter now have 25.000 fingering perch available to trade as requested by your representative, O'Brien. 'Wire if your 200 adult black bass are ready to load latter part of this week, and if you guarantee expenses of run ning our fish car from Nebraska state line to Oklahoma and return. Im mediate action necessary, as perch now impounded.' "Every action of mine in connec tion with this case was presented in detail by Commissioned Endacott to Governor Weaver of Nebraska, and the governor, after due deliberation, decided the case as indicated by the telegram sent to Mr. Endacott. Ti governor has my sincere thanks for the action he has taken." Mr. O'Brien praises Governor Weaver as "Justly recognized by sportsmen as one of the outstand ing conservationists of the country," states that the governor worked dur ing the legislature for the passage of a bill for a fish, game and park commission, and after the bill became law appointed a remarkably good board, every one of them high class sportsmen who have the interests of conservation at heart. He says that the board's plans will be of great value and has the promise of increasing the output of fish with out the construction of additional state owned hatcheries, the plan be ing to encourage the building of pri vately owned hatcheries where fish, especially bass, may be raised and sold to the state for restocking public waters.
