Governor McMullen said the appoint ment is to take effect when a com mission is issued, and this will not be done until he consults with Chief Justice Goss regarding the time the court desires the new judge to as sume his duties. The appointee de sires a little time to adjust his busi ness affairs. Judge Day's salary has been paid up to the end of the quar ter which ends during the first week in January. The pay of the new judge will begin when the commis sion is issued by the governor. Mr. Howell, it is understood ' by the governor who had a talk with him Wednesday, is to become a can didate for the full six year term, be ginning the first week in January, 1929. As the primary election for nominations is to be held April 19. 1928, and nominations must be filed thirty days prior to the primary, fil ings must be made within the next two months. The supreme judge dis trict comprises Douglas, Sarpy and Washington counties. "Mr. Howell seemed to have al most the unanimous endorsement of people in Omaha." said oGvernor McMullen. "The bar there appears to be for him, tho no bar action was taken. People outside the bar who endorsed him probably outnum ber those of the bar. Every one who seems to be interested appears to favor his appointment." The governor was asked concern ing a newspaper publication which Ftatod that Mr. Howell has at. one (ime made an address in which he spoke against the Volstead act, a federal prohibition law which judges of the supreme court of Nebraska are not called upon to enforce. "No protests, objections or charges of any kind were filed against Mr. Howeil," said the governor. " I be lieve he possesses what 1 consider the requisites for a judge. He has abil ity, integrity, honesty and judgment. Many a man possessing ability alone is not fit for judge." Governor McMullen said no one had made formal application for ap pointment, but one or two in ad dition to Mr. Howell had been sug gested by their friends. Judges Redick, Troup, Leslie and Rait of the district bench in this supreme court district had been suggested, but it was understood none of these desired to leave their present posi tions. The governorsaid he had a con ference Wednesday with Mr. Howell because he makes it a rule not to appoint to such responsible positions without first talking with the one of his choice. This is Governor McMullen's thirteenthe judicial appointment. He has appointed two judges of the supreme court, six supreme court commissioners and five judges of the district court.
