The secretary of the interior has re
quested Attorney General Brewster to

pel the goverument to allow that
state five per cent ot the net proceeds
of the sales of public lauds within the

The statement of the United States
treasurer shows gold, silver, United
States notes in the treasury aa fol-

SMUGGLERS.
It is reported to tlyj treasury depart
ment that smuggling is beinu extensive
ly practiced on the Bio Grande river.and
that a difference of opinion exists be
tween the district attorney for the south
ern district of Texas ami collector of
customs at Brownsville, as to the author-
ty of the ollirers of the latter to arrest
K-rsous detected in the act of smuggling.
The question has been referred to the
solicitor of the treasury for an opinion.
The solicitor fays be has no doubt that
the officers have the samenght to arrest
offenders that they have to sieze smug
gled goods, providing the arrest is not
made on Mexican territory.

ial hospital have purchased a piece of
property situated in the suburbs of this
city, at a cost of $37,000. The money
to be realized from the soldiers7 and
sailors' orphan asylum property, which
was donated to the Garfield hospital.

provided. One of the exlravagant
features is the erection of a number
of private boxis and stalls. Ten

the "Jersey Lily" have been ho widely
commented on, threatened to repeat
his St. Lmiis experience last evening,
by attacking John A. Shrever. a re
porter of the Baltimore- American,
Shrever wrote up and published an ac
count what purported to be an inter
view between Mrs. Langtry and him

Last evening Freddie approached
Shrever, who was standing in the
lobby, and in an abrupt iaanner want
ed to know by what authority he had
presumed to write such an interview.
and Shrever finally admitted his card,
which he had sent to Mrs. Langtry,
had been returned, but she had been
interviewed by an American reporter
while on the train en route to Balti
more rrom Washington. Gebhardt
characterized the whole matter of the
interview as a lie, and remarked, "That
he could whip a liar," and threatened
unless retraction was made he would
treat Shrever as he had treated Cun
ningham in St. Louis. He further
threatens to publish a card over Mrs.
Langtry 's signature, denying the fact
of the reported interview. The Amer
ican this morning admits there was no
interview with the reporter of the pa
per Thursday night, and whether that
will satisfy Gebhardt remains to be
seen.
THE IOWA amendment.
Dubuque, Iowa, April 21. The de
cision In the amendment case was not
filed until 5 o'clock this afternoon.
The opinions are voluminous, the ma
jority covering 84 pages of legal cap,
and the minority, consisting of Judge
Beck alone, covering 113 pages. The
I majority opinion is in harmony with

claring the amendment null and void.
The opinion of the court was delivered
by Chief Justice Day. On the only
new question raised in the argument
for rehearing, that of jurisdiction, the
court is positive that the courts are
instituted for the purpose of adjudi
cating the acts of the legislature. The
court says, a petition for a rehearing
was presented in this cause and whole
cases have been reargued by eminent
counsel with much ability and re
search. In view of the great interest
which has attached to this question.
and of its public importance, it is
deemed not only proper but necessary
to examine with considerable fullness
the leading points relied upon as ne
cessitating a conclusion different from
ths one reached in the foregoing opin
ion, li is asserted in tne opinion ior
rehearing, that the judicial department
of the state has not jarisdiction over
a political question and cannot review
the action of ftie fifteenth general as
sembly of the people in the matter of
the adoption or amendment of the con
stitution of the state. This position
practically amounts to this: That pro
visions, of the constitution lor its own
amendment ate simply directory and
may be disregarded with impunity, for
it is idle to say that these requirements
of the constitution must be observed
If departments charged with their ob
servance are the sole judges as to
whether or not they have been com
plied with. This proposition was ad
vanced for the first time upon the pe
tition for a rehearing, and if correct
it is of course an end to the contro
