Boyd and Tbajar was y rfced jeBterday by the action of the supreme coirt opon Governor Thayer's application for permission to file an information in qua warranto It will be remembered that the information of Gorernor Thayer was offered last Satur- day, and the supreme court asked until Tueaday to decide whether rr not the issuance of a writ as prayed would afford any relief to John M. Thayer, and whether, theretoret be had any right n the matter. When court opened yes terday the court room was filled to bear the decision, which was as follows: "State of Nebraska, ex rel.John M.Thayer ts. James K. oyd. Last rnaay mornine ap plication was niad to file au information in iae nature of a quo warranto by John M. Thayer against James E. Boyd, We have beea given but little opportunity of coatultation aud tsonsi Jeration of this matter, but an t me is passing and these matters are of great impor tance to the parties in court, as well as t the paople generally, we have concluded, as a mere matter of lonn and proceeding, and as a marter of notice, as well as of jurisdiction, to ladicate that a summons may be issued re turnable according to the statutes governiug the issuance of summons In the district court Here. Elias Grinker, an intelligent German, and brother-in-law of Isaac Nathan, of Geneva, came oyer from the old country three years ago. leaving a young wife behind, with ber parents, to follow. But since, she coacluded to remain at the solicitation ef her parents, in the mother country, and Mr. Grinker left this morning to join her, stopping in the city over night, the guest of Levi Golding. It isn't generally understoad that Posey Measersmith is a first class farmer, but he is. .Last year he raised strawberries that three f them made a pint. His chickens stood square on the ground and eat off the top of a flour barrel, some of them were nearly as large as a sheep. C. i. Twiss is a great fellow for sur prises and enjoys himself immensely when tie laugh is on the other fellow, last night the tables were turned and be was the victim. It seems that Mr. Twiss was getting up a birthday surprise his wife for Thursday night and aad invited several members of the lodge (I. O. O. F.) up to participate, but they learned that Thursday was the wrong day and that Tuesday night would be the proper time. So Peter Bates unbeknown to Mr Twiss invited a large party to visit the Twiss mansion in the Third ward for Tuesday night The party consisted of ninety four people the largest surprise party of the year marched in a body from Mr. Bates house and while Mr. Twits was at lodge they took Mrs. Twiss by surpriso and paralyzed Mr. Twiss a few momenta later when he and Peter Bates innocently wandered in. A delightful evening was spent and as a memento of the occasion Mrs. Twiss re ceived a beautiful hanging lamp and Mr, Twiss a nice silk muffler. Mr. Twiss says he did not think they conld put up a job on him but while be was chuck ling over how he would fool bis wife they sprung the trap on him which worked to a nicety. Bank Elections.
