By morely following the decision of a higher court the district federal judges of Nebraska can wino out the 2-cent fnro law and havo tho maximum com modity rate law that has saved mil lions of 'dollars In passenger fars and freight rates in Nebraska. Judge Sanborn of tho circuit court of appeals wrote an opplnion in the Minne sota rate caBcs that practically emascu lates overy state railway commission, so inr as its rate mauing powers are It A . concerned. He, moreover, laid down certain dlcto about tho calculation of expense and tho division of Incomo that would probably show that tho Nebraska IawB arc confiscatory. Being tho judgo of a circuit in which the fetlernl courts In this stato are but a small part it would bo tho duty and almost certain aqtion of tho district fedoral judges to follow this decision if the Nebraska cobob wero to bo submitted nt tho present time. But beforo tho Sanborn decision is final it must bo passed on by the su- prome court of tho United State; bo foro the railroads know definitely their position the Missouri rate case, also coming In tho samo judicial circuit, must be passed upon by tho higher court; only tho law as applied to the Rock Island railroad has been heard fully in thlB stato and tho state can reasonably ask that evidence as to tho effect of tho laws on all of tho roads shall bo heard beforo tho validity of tho law Is decided. This delay also allows tho laws to continue in effoct. Cooney Acquitted. At Kearney Tuesday night a jury brought in a verdict of not guilty In tho case of Patrick E. Cooney, charged by tho state with tho murdor of Elmor Morcer on tho night of December 21. Tho jury was out two hours. Four of tho most prominent lawyers of that pnrt of tho fctnto wero engaged by Loonoyy whllo tho county attornoy and the city attorney of Kearney conducted tho prosecution.
